What Changed Recently?

On October 16, 2026, the court granted preliminary approval to a $2.5 million settlement in A.B. v. Genesys Cloud Services, Inc., a proposed class action filed in April 2025. The plaintiffs alleged that Genesys, which supplied communications software used by the National Domestic Violence Hotline, captured people’s calls, texts and chats with the Hotline in violation of the federal Electronic Communications Privacy Act and the California Invasion of Privacy Act. Genesys denies all of the allegations.

Judge Chen first heard the motion on August 27, 2026, then asked for supplemental briefing and changes to the settlement agreement, notice plan and claim form before approving it. The order acknowledges the steep discount from the estimated maximum trial value but cites the uncertain mechanics of the alleged interception and the difficulty of identifying anonymous class members.

Who Qualifies?

The settlement class covers all natural persons who, while residents of and present in California, communicated with the National Domestic Violence Hotline through any channel from April 11, 2023 to the date of final judgment. The court estimates the class at about 100,000 people.

Genesys, its parents, subsidiaries, affiliates, officers, directors, investors and employees, any entity Genesys controls, and the judge and court staff are excluded.

How Much Can You Get?

Valid claimants receive an equal pro rata share of the net settlement fund, capped at $1,250 per person. The net fund is the $2.5 million total minus:
The final per-person amount depends on how many valid claims are filed, so the $1,250 figure is a ceiling, not an estimate. Money left after a feasible distribution goes to the Hotline, subject to court approval. Class counsel’s fee request is due by December 10, 2026.

What Proof or Notice ID Is Required?

The online claim form has not opened, so OpenClassActions.com has not been able to confirm what it asks for. According to the court order, claimants will only be required to provide their full name, street name, ZIP code and email address. A street number, city and phone number are optional.

Notice is being given by publication only, so no notice letters or notice ID numbers are being mailed. This page will be updated once the online form can be checked.

What Is the Deadline?

The claim form deadline is January 29, 2027. The deadline to opt out or object is January 14, 2027. The order does not specify a time of day or time zone.

How Do You Take Action?

There is nothing to file yet. The court approved a settlement website and toll-free line run by the administrator, Eisner Advisory Group LLC (EisnerAmper), but their details had not been published as of October 17, 2026. Notice is scheduled to begin by November 30, 2026, through a banner on the Hotline’s website shown to visitors in California and advertisements in 12 California newspapers, including the Los Angeles Times and the San Francisco Chronicle.

The court order lists six payment options: Venmo, Zelle, PayPal, a prepaid digital Mastercard, a paper check or direct deposit. The court said these options were chosen to reduce the chance of alerting someone else that a person is a class member. Under the order, the administrator must keep class members’ identities and contact information confidential, and people who opt out or object will not be contacted without their consent.

What Happens Next?

The administrator has until November 30, 2026 to begin notice. Class counsel’s motion for fees and service awards is due December 10, 2026, opt-outs and objections are due January 14, 2027, and claims are due January 29, 2027. Judge Chen will hold the final approval hearing on March 4, 2027 at 1:30 p.m. in Courtroom 5. Payments would follow only if the court grants final approval.

Questions

Why is the settlement not giving each person a fixed amount?

The money left after the cy pres award, administration costs, any attorneys’ fees and service awards is divided equally among valid claims, up to a $1,250 cap per person. The per-person amount depends on how many of the roughly 100,000 class members file. If every class member filed, each share would be a small fraction of the cap.

Will the settlement contact class members directly?

No. Because direct outreach could expose class members to abuse, the court approved notice by publication only: a 60-day banner on the Hotline’s website shown to visitors in California, plus advertisements in 12 California newspapers. No individual notices or notice ID numbers are being sent.

How will payments be sent?

The court order lists six payment options: Venmo, Zelle, PayPal, a prepaid digital Mastercard, a paper check or direct deposit. The court noted that a prepaid digital Mastercard can be delivered using only an email address, with no bank deposit.

Does the Hotline get money from the settlement?

Yes. At least $500,000 goes to the National Domestic Violence Hotline as a cy pres award, to be used only for domestic violence awareness campaigns in California high schools and colleges and to hire additional Hotline advocates. The Hotline is not a defendant and is not released by the settlement.

Did Genesys admit wrongdoing?

No. Genesys Cloud Services denies all of the allegations and agreed to settle without any finding that it intercepted or recorded Hotline communications unlawfully.
