What Changed?

The claim deadline for the $15 million settlement in In re Bestway Above-Ground Pools Litigation, Case No. 1:25-cv-09570 in the U.S. District Court for the Northern District of Illinois, has been extended from October 30 to November 19, 2026. The official settlement website, run by administrator Eisner Advisory Group, now reads that “the claims deadline has been extended to November 19, 2026,” and its online claim form is accepting claims again.

Only the claim deadline moved. The website lists the exclusion and objection deadlines as passed, and the fairness hearing is still set for November 20, 2026, the day after claims now close.

Who Can Still File?

The settlement class covers people in the United States, its territories and the District of Columbia who bought, for personal use and not for resale, a Bestway-branded above-ground pool 48 inches or taller, including Power Steel, Steel Pro and Coleman Power Steel models, with compression straps running outside the vertical support legs, sold from 2008 through 2024.

The settlement pays $40 per household with no receipt, or 10% of the price paid with valid proof of purchase, and payments may be adjusted pro rata. The full eligibility rules, payment options and filing steps are on OCA’s Bestway pool settlement page.

What Is the Case About?

The lawsuit followed a July 2025 recall in which the U.S. Consumer Product Safety Commission said the outside compression strap on certain above-ground pools can give a small child a foothold to climb in. The complaint alleges the Bestway pools were defective and that the recall, which offered a free repair kit, was inadequate. Bestway denies the pools are defective and denies wrongdoing, and the court has not decided who is right. The settlement does not release personal injury or wrongful death claims and does not limit any rights under the recall.

What Happens Next?

The court will consider final approval at the November 20, 2026 fairness hearing. No payments will go out unless the court approves the settlement and any appeals are resolved, and no payment date has been announced.

Questions

Did anything besides the claim deadline change?

Not according to the settlement website. The payment amounts, the class definition and the November 20, 2026 fairness hearing are unchanged. The deadlines to opt out and to object were not extended; the website lists both as passed.

Someone already filed before October 30. Do they need to file again?

The settlement website does not ask anyone to refile, and the settlement allows one claim per household. The extension adds time for people who had not yet filed.

Is the Bestway spa pump settlement extended too?

No. The extension applies only to the above-ground pool case in federal court in Illinois. The Bestway AirJet and HydroJet spa pump settlement is a separate case in Arizona with its own deadlines.
