Bestway Spa Pump Settlement Hearing Moved to November 4, 2026 — What It Means for Payments of Up to $75

Published October 7, 2026

Buyers of recalled Bestway AirJet and HydroJet spa pumps who filed claims in the Bestway spa pump settlement will wait longer for payment: the court hearing where a judge decides whether to approve the settlement was moved from September 18 to November 4, 2026. Claims closed October 5, 2026; the separate Bestway above-ground pool settlement is still open through October 30.

The Court Hearing Was Moved to November 4

The official settlement website for the Bestway spa pump case, Armstrong et al. v. Bestway (USA) Inc., No. 2:24-cv-02812-DMF, in federal court in Arizona, now says the Final Approval Hearing has been rescheduled to November 4, 2026 at 9:00 a.m. Mountain Standard Time. It had been set for September 18, 2026. The website does not give a reason for the change.

A final approval hearing is the court date where the judge decides whether the settlement is fair and gives it the green light. Until that happens, the settlement is only a proposal, and nobody gets paid. Moving the hearing back about seven weeks moves the earliest possible payment date back with it.

When Will Bestway Spa Pump Payments Arrive?

No payment date has been announced. Payments of up to $75 can start only after three things happen: the judge approves the settlement at or after the November 4 hearing, the time to appeal that approval runs out (often about 30 days), and the settlement administrator processes the approved claims. If anyone appeals, payments wait until the appeal is resolved.

The $75 figure is a maximum. The settlement has a $2 million cash fund, and if valid claims add up to more than that, every payment is reduced by the same proportion. The money is in addition to whatever buyers received through the 2024 CPSC recall of the pumps. Bestway denies wrongdoing.

The Claim Deadline Was Extended, and Has Now Passed

The deadline to file a claim, opt out or object was also pushed back, from August 17, 2026 to October 5, 2026. That extended deadline passed two days ago, so the claim window is closed. The full settlement breakdown is on OCA's Bestway spa pump settlement page.

Two Bestway Settlements, Side by Side

Bestway is the defendant in two unrelated class action settlements this year, and they are easy to confuse. They cover different products, sit in different courts and run on different deadlines. A claim filed in one is not a claim in the other.

The Bestway Pool Settlement Is Still Taking Claims

Eligible owners can claim $40 without a receipt, or 10% of the price paid with valid proof of purchase. Claims, exclusion requests and objections are all due October 30, 2026, on the official Pool Settlement BW website. The court has not yet approved that settlement; its fairness hearing is November 20, 2026.

Questions

What is a final approval hearing?

A final approval hearing is the court date where the judge reviews a proposed class action settlement, hears any objections, and decides whether to approve it. Settlement payments cannot be made until the judge approves the settlement and the time for appeals has passed. In the Bestway spa pump case, that hearing is now November 4, 2026.

Can a claim still be filed in the Bestway spa pump settlement?

No. The claim deadline in Armstrong et al. v. Bestway (USA) Inc. was extended from August 17, 2026 to October 5, 2026, and that date has passed. The opt-out and objection deadlines were also October 5, 2026.

When will the Bestway spa pump settlement pay?

No payment date has been set. The Final Approval Hearing was rescheduled from September 18 to November 4, 2026 at 9:00 a.m. (MST) in the U.S. District Court for the District of Arizona. Payments can be made only after the court grants final approval and any appeals are resolved.

Is the Bestway pool settlement the same as the spa pump settlement?

No. They are separate cases covering different products. The spa pump settlement, in federal court in Arizona, covers nine recalled AirJet and HydroJet spa pump models sold from May 2021 to May 2024. The pool settlement, In re Bestway Above-Ground Pools Litigation in federal court in Illinois, covers Bestway above-ground pools 48 inches or taller with compression straps outside the support poles, sold from 2008 to 2024. Filing in one does not file a claim in the other.

Is proof of purchase required for the Bestway pool settlement?

No. Eligible pool owners can claim $40 without a receipt, or 10% of the price paid with valid proof of purchase. A Settlement Claim ID is optional, but the claim form asks for the pool's brand, dimensions and model or serial number. Claims close October 30, 2026.
