Class counsel announced on July 9, 2026 that two of the four defendant groups in Canada's national beef price-fixing class actions have agreed to proposed settlements totaling roughly $8 million CAD. JBS entities — JBS USA Food Company, Swift Beef Company, JBS Packerland and JBS Canada — agreed to pay $7,498,700, and National Beef Packing Company agreed to pay $495,000. Neither admits wrongdoing.
The settlements resolve claims against JBS and National Beef only. The litigation continues against the remaining defendants — Cargill, Incorporated, Cargill Meat Solutions, Cargill Limited, Tyson Foods and Tyson Fresh Meats — and, in a common early-settlement structure, the settling companies agreed to cooperate with the plaintiffs as the case proceeds against them.

The national class covers all persons in Canada who purchased beef after January 1, 2015 — directly or indirectly, for resale or for personal use — excluding processed "beef products" and beef purchased from the food-service industry, such as restaurant meals. Quebec residents are covered by a parallel class action brought by Option consommateurs in the Quebec Superior Court, with the same January 1, 2015 start date.
In practical terms, that means most Canadians who bought beef at a grocery store or butcher in the past decade are potentially class members. Because the class is defined by ordinary retail purchases going back years, any eventual claims process is likely to matter to a very large number of households — but the shape of that process has not been decided.
The class actions, filed in 2022, allege that the major meatpackers conspired to fix, maintain, or lessen the production and supply of beef and to fix, raise, or stabilize the prices of beef sold to purchasers in Canada, starting at least as early as January 1, 2015. The national case — Bui v. Cargill, Incorporated — was brought in the Supreme Court of British Columbia by a Vancouver resident who bought beef for his family, and was certified in October 2025, with certification for settlement purposes following on October 29, 2025.
These are allegations. The settling defendants deny wrongdoing and settled without any admission of liability, and the claims against the Cargill and Tyson defendants remain unproven and contested. The same four packer groups face parallel price-fixing litigation in the United States, where separate consumer settlements have been reached — the U.S. and Canadian cases are distinct, with different classes and deadlines.
- August 10, 2026 — deadline to opt out of the class by sending a signed written election to class counsel. Class members who do nothing stay in the class.
- September 10, 2026 — settlement approval hearing in the Supreme Court of British Columbia in Vancouver (covers all Canadian class members outside Quebec).
- December 1, 2026 — settlement approval hearing in the Quebec Superior Court in Montréal.
There is nothing to file today. The settlements take effect only if the courts approve them, individual payment amounts have not been determined, and distribution will follow a court-approved protocol at a later stage — likely influenced by how the continuing case against Cargill and Tyson resolves. The official case website is Beef Class Action.ca, run by class counsel; that is where notice documents and any future claims process will appear. We will update this page when a claims process opens.
Who is included in the Canadian beef price-fixing class action?
The national class covers all persons in Canada (Quebec residents are covered by a parallel Quebec class) who purchased beef after January 1, 2015 — whether directly or indirectly, for resale or personal use — excluding processed beef products and beef purchased from the food-service industry, such as restaurant meals.
How much is the Canadian beef settlement and who is paying?
Two settling defendant groups will pay a combined total of about $7.99 million CAD: JBS entities (JBS USA Food Company, Swift Beef Company, JBS Packerland and JBS Canada) will pay $7,498,700, and National Beef Packing Company will pay $495,000. Neither admits wrongdoing, and both agreed to cooperate with the plaintiffs as the case continues against Cargill and Tyson defendants.
Can I file a claim for the beef settlement now?
No. There is no claim form yet. The settlements must first be approved by the courts — the British Columbia hearing is set for September 10, 2026, and the Quebec hearing for December 1, 2026. Individual payment amounts have not been determined, and a distribution plan will come later, partly because the lawsuit continues against the remaining defendants.
What are the beef price-fixing allegations about?
Plaintiffs allege that major meatpackers conspired to restrict the production and supply of beef and to fix, raise, or stabilize beef prices sold to purchasers in Canada, starting at least as early as January 1, 2015. The settling defendants do not admit wrongdoing, and the allegations against the non-settling Cargill and Tyson defendants remain unproven and contested.
What is the deadline to opt out of the Canadian beef class action?
Class members who want to exclude themselves must send a signed written opt-out election to class counsel by August 10, 2026. Class members who do nothing remain in the class and will be eligible for any court-approved distribution later.
