Juul Claimants Who Cashed Their First Check May Receive a Second Payment

Class counsel filed a motion on February 26, 2026 to distribute $15,371,264.82 in remaining funds from the $300 million Juul class action settlement. If the court approves the proposed order, approximately 165,982 eligible claimants will receive an additional settlement payment. No action is required to receive the second payment.

The remaining funds exist because a significant number of claimants from the first distribution never cashed their checks or accepted their digital payments. Of the 843,451 claimants who were approved in the original settlement, 733,055 collected their first payment. The unclaimed payments from the remaining 110,396 claimants are now being redistributed.

Who Is Eligible for the Second Juul Payment?

To qualify for the second distribution, claimants must meet two criteria. First, they must have received and deposited their original settlement payment from the first distribution. Second, under the plan of allocation using the calculated points from the initial distribution, their redistribution payment must be $15 or more.

According to the proposed order, 165,982 claimants are eligible to receive an additional payment.

How Much Will the Second Payment Be?

The settlement administrator will calculate each eligible claimant's second payment using the same allocation formula from the original distribution, which was based on how much each person spent on Juul products. The average second payment will be approximately $92.48. The largest individual payment will be $1,413.63.

After setting aside $20,000 for tax obligations, the full $15,351,264.82 will be distributed to eligible claimants.

Do I Need to Do Anything to Receive the Second Payment?

No. Eligible class members do not need to take any action. The settlement administrator will automatically issue second payments using the same payment method from the first distribution. Payment options include Virtual MasterCard, Amazon card, Venmo, PayPal, ACH direct deposit, or paper check (for some claimants in the second distribution).

What Was the Juul Class Action Settlement About?

The class action lawsuit alleged that Juul Labs Inc. and Altria misled consumers about the addictiveness and safety of Juul e-cigarette products. The plaintiffs claimed that consumers paid more for Juul products than they would have if the companies had provided accurate information. The lawsuit also alleged that Juul unlawfully marketed its products to minors through social media campaigns, candy-flavored nicotine pods, and advertising that appealed to young people.

The case was originally filed in 2018 and consolidated into a multidistrict litigation in the Northern District of California before Judge William H. Orrick. After years of litigation, document discovery, over 100 depositions, and a bellwether trial, Juul agreed to pay $255 million and Altria agreed to pay an additional $45,531,250, bringing the total settlement to just over $300 million. The court granted final approval to the Juul settlement in September 2023 and to the Altria settlement in March 2024.

Both defendants denied the allegations and did not admit wrongdoing. The court did not rule on whether either company violated any laws.

How Were the Original Payments Calculated?

Settlement payments were not divided equally among claimants. The Plan of Allocation used a points-based system that weighted payments based on how much each person spent on Juul products and when they started using them.

Each claimant's purchases were assigned points using a multiplier system. Youth purchases (by individuals who first bought Juul products before turning 18) received the highest weight at 4 times the retail expenditure. Purchases by adults who first started buying Juul products between 2015 and 2018 received 2 times the retail expenditure. Purchases by adults who first started buying between 2019 and 2022 received 1 times the retail expenditure. This weighting system meant that minors who were targeted by Juul's marketing and early adopters who were exposed to the products before the risks were widely understood received proportionally larger payments.

The payment for each claimant was capped at 150% of their total retail spending on Juul products. For youth purchases, the cap was higher at 300% of what was spent. Every eligible claimant received a minimum payment of at least $15.

For claimants who bought directly from Juul's website, the company's own electronic records were used to calculate the amount spent. For purchases made at retail stores, claimants could submit receipts or use standard retail prices set in the plan: $15.99 for a 4-pack of JUULPods, $9.99 for a 2-pack, $49.99 for a starter kit with 4 pods, $44.99 for a starter kit with 2 pods, $34.99 for a device kit, $49.99 for a charging case, and $6.00 for a USB charger. Claims for retail purchases exceeding $300 without proof of purchase were capped at $300. No claimant could claim more than $1,600 per year in retail expenditures.

During the initial payment round, which ran from October 18, 2024 through May 30, 2025, payments ranged from $15 to over $10,000, with an average payout of approximately $240.

How Is the Second Distribution Calculated?

The second distribution follows the same points-based formula from the original Plan of Allocation. The redistribution only includes claimants who collected their first payment and whose recalculated share would be at least $15. The total points are recalculated using only the points of eligible redistribution claimants. Each person's share of the remaining $15.35 million is proportional to their original points. No claimant can receive a redistribution that would push their total payments above their original payment cap (150% of retail spending, or 300% for youth purchases).

What is Juul?

Juul Labs is an e-cigarette company founded in 2015 that quickly became the dominant vaping brand in the United States. By the fall of 2018, Juul held a 72% share of the e-cigarette market. The company's sleek, USB-shaped device and flavored nicotine pods became extremely popular among teenagers, sparking a national debate about youth vaping.

Juul has faced massive legal consequences for its marketing practices. In addition to the $300 million consumer class action, Juul has settled with 48 states and territories for more than $1 billion over claims that it targeted minors. The company also reached a $1.2 billion settlement with approximately 10,000 individual plaintiffs. Altria, the tobacco giant that previously held a 35% stake in Juul, exited its position in the company after acquiring a competing e-cigarette brand.

Individual Juul pods contain nicotine levels equivalent to approximately 20 cigarettes. The FDA initially moved to ban Juul products in 2022 but later rescinded that order pending additional health reviews. Juul's market share had dropped to approximately 28% by late 2022 amid the regulatory and legal pressure.
