What's This Settlement About?

Apple has agreed to settle a $100,000,000 Class Action as a result of a lawsuit. The lawsuit alleged that Apple willfully acquired and maintained monopoly power by refusing to allow iOS device users to purchase iOS apps and in-app products other than through its own App Store. Apple allegedly refused to allow other app stores to be allowed on its devices and mandated that iOS developers who sell through the App Store cannot sell their apps though any other means that are meant to reach iOS device consumers, an exclusivity clause.

The lawsuit also alleged, on behalf of Apple's App Store developers that Apple abused its market power by charging a wildly anti-competitive commission rate that it could only achieve by being monopolistic and anti-competitive, or by making artificially low payments to iOS developers for digital products sold in the App Store. The class action lawsuit also challenged Apple's pricing tiers ending in $.99 as being anti-competitive on behalf of ordinary App Developers.

How Do I Qualify?

All former or current U.S. developers of any Apple iOS application or in-app product (including subscriptions) sold for a non-zero price via Apple's iOS App Store that earned proceeds equal to or less than $1,000,000.00 through the United States App Store. This must have occurred through the developer account from 2015-2021. For class definition purposes, the 2015 calendar year shall consist of June 4, 2015, through December 31, 2015. The 2021 calendar year shall consist of January 1, 2021, through April 26, 2021, the last date in 2021 for which there are available developer transactional data as produced in this Action are the part of this settlement.

What Can I Get?

The Small Developer Assistance Fund in the amount of $100M will be distributed to all Settlement Class Members who submit timely and valid claim forms. Each such U.S. developer will be entitled to a minimum payment of $250.00. U.S. developers may qualify for a higher payment based on their total proceeds during the relevant period (from June 4, 2015-December 31, 2020).
