What Is This Settlement About?

Absolute Dental Group, LLC, a Nevada dental chain with more than 50 locations, agreed to a $3.3 million class action settlement resolving claims over a 2025 data security incident. Between February 19 and March 5, 2025, an unauthorized party accessed company systems using a compromised third-party IT vendor account, potentially exposing the personal and health information of roughly 1.2 million people.

Absolute Dental denies any wrongdoing, and the court has not decided who is right. Both sides agreed to settle to avoid the cost and uncertainty of continued litigation, and Absolute Dental has also agreed to maintain changes and enhancements to its data security at its own expense. The settlement received preliminary approval, and the claims window is open now — but it is short: claims must be submitted by June 18, 2026. Note that the settlement resolves claims against Absolute Dental only; it does not resolve the lawsuit's claims against co-defendant Judge Consulting, Inc.

Who Qualifies?

The settlement class is defined as all living, natural persons residing in the United States whose personal information was potentially impacted in the data incident that occurred between February 19, 2025 and March 5, 2025 — including everyone who was sent notice of the incident. Approximately 1,223,437 people are covered.

How Much Can You Get?

Class members can claim one or both of two cash benefits from the $3.3 million settlement fund:

• Documented Loss Payment: reimbursement of up to $5,000 for documented, unreimbursed losses more likely than not caused by the data incident — for example bank fees, long-distance or metered phone and data charges, postage, gasoline for local travel, and fees for credit reports, credit monitoring, or identity theft insurance products. Third-party documentation (statements, invoices, receipts, telephone records) is required; a personal statement alone is not enough.
• Cash Fund Payment: a pro rata cash payment from the net settlement fund, with the final amount calculated after the claims deadline based on how many valid claims are filed. You can claim this in addition to a Documented Loss Payment.

Class members who were California residents at the time of the breach (as shown by the defendant's records) may be entitled to additional relief of up to two times the Cash Fund Payment. Separately, Absolute Dental offered affected individuals two years of free identity monitoring through its breach notification letters; enrollment details were included in that notice.

Important Deadlines

The deadline to submit a claim is June 18, 2026 — online submissions and mailed claims must be in or postmarked by that date. The deadline to exclude yourself from or object to the settlement was June 9, 2026, and has passed. The court will hold the final approval hearing on Thursday, July 30, 2026 at 10:00 a.m. at the Lloyd D. George Federal Courthouse in Las Vegas; payments are issued only after the settlement receives final approval and any appeals are resolved.
