Category B
Description: Individuals whose Aetna member files contain qualifying IUI codes but do not establish whether they were in an Eligible LGBTQ+ Relationship during the Class Period.
Qualification: Must submit an Attestation to confirm eligibility.
Payment: Default Dollars for Benefits Amount of $2,300 upon timely submission of the Attestation and address verification.

Category C
Description: Individuals whose Aetna member files contain qualifying IVF-only codes but do not establish their IUI history or whether they were in an Eligible LGBTQ+ Relationship during the Class Period.
Qualification: Must submit both a Claim Form Submission and an Attestation to confirm eligibility.
Payment: Default Dollars for Benefits Amount of $2,300 upon timely submission of the required forms and address verification.

Category D-A & D-B
Individuals whose member files contain a denial of a claim or precertification request for qualifying artificial insemination codes, followed by an approval within 90 days or otherwise paid by Aetna, and whose files may or may not contain information indicating eligibility to participate in the settlement.

Description: Potential Class Members identified by the parties, including individuals in Categories A, B, and C.
Notification: Will receive direct notice of the settlement, including information on their right to opt out and the opportunity to submit required forms for additional payments.

Published Notice
Description: Allows individuals not previously identified to submit claims.

Up to $12,300 is available to qualifying individuals, consisting of a $10,000 Default Common Fund Amount payment and a $2,300 Default Dollars for Benefits Amount payment.

How Do I File a Claim?

To potentially qualify for a payout, you must be a member of the class, which includes individuals in an eligible LGBTQ+ relationship who were covered by an Aetna health plan in New York and sought or were denied coverage for infertility treatments during the class period (September 1, 2017, to May 31, 2024). For the different categories or tiers of class action members an attestation form may be necessary, and if required, a Claim Submission Form with supporting evidence must be submitted by August 26, 2025 at the very latest.
