Payout: Up to $2,500 (documented losses) or $45 (cash payment) + 2 years credit monitoring
What is the Ashley Furniture Data Breach Settlement?
If you received a notification from Dufresne Spencer Group (which operates Ashley Furniture HomeStore locations) that your personal information was potentially compromised in a data breach that occurred between May 15, 2023 and June 5, 2023, you may be eligible for benefits from a class action settlement. You can claim up to $2,500 for documented losses, a $45 cash payment with no documentation required, and 2 years of free 3-bureau credit monitoring. The deadline to file a claim is March 19, 2026.
The lawsuit alleged that unauthorized individuals gained access to Dufresne's computer systems and accessed files containing sensitive personal information about employees and customers. Dufresne denies all claims and denies any wrongdoing. The parties agreed to settle to avoid the cost and disruption of continued litigation.
What is Dufresne Spencer Group / Ashley Furniture HomeStore?
Dufresne Spencer Group LLC is a company that operates Ashley Furniture HomeStore locations. Ashley Furniture HomeStore is one of the largest furniture retail brands in the United States, selling home furnishings including sofas, beds, dining sets, mattresses, and home decor. The Dufresne Spencer Group operates multiple Ashley Furniture HomeStore franchise locations and maintains systems that store personal information for both employees and customers.
This settlement involves the Dufresne Spencer Group's systems specifically, not all Ashley Furniture HomeStore locations nationwide. If you received a data breach notification letter from Dufresne Spencer Group, you are likely a class member regardless of which specific Ashley Furniture location you interacted with.
What Happened in the Data Breach?
Between May 15, 2023 and June 5, 2023, unauthorized individuals gained access to Dufresne Spencer Group's computer systems and certain files containing sensitive personal information. After discovering the breach, Dufresne sent notification letters to individuals whose information may have been affected.
The types of personal information potentially exposed in the breach were extensive and included names, contact information, banking information (account and routing numbers) submitted for expense reimbursement, dates of birth, Social Security numbers and ITINs, driver's licenses, passports, digital signatures, payment card numbers, payment card CVV codes, military identification, permanent resident cards, medical diagnoses, medical treatment information, voting identification, and foreign identification documents.
This is a particularly serious data breach because of the wide range of sensitive information that was potentially accessed. The combination of Social Security numbers, banking details, payment card information, and medical records creates significant risks for identity theft, financial fraud, and medical identity theft.
Who Qualifies for the Ashley Furniture Settlement?
You are a settlement class member if you reside in the United States and were sent written notification by Dufresne Spencer Group that your personal information was potentially accessed, viewed, or obtained as a result of the data breach that occurred between May 15, 2023 and June 5, 2023.
If you received a breach notification letter from Dufresne Spencer Group, you are very likely eligible for settlement benefits.
How Much Money Will I Get?
There are multiple payment options available. You can choose between documented losses or a flat cash payment:
Option 1 — Documented Losses (up to $2,500 total):
Documented Out-of-Pocket Losses (up to $500): Reimbursement for expenses incurred as a result of the data breach including unreimbursed bank fees, phone charges, postage, gasoline for local travel, and fees for credit reports or identity theft products purchased between May 15, 2023 and the claims deadline. Supporting documentation is required.
Documented Extraordinary Losses (up to $2,500): Reimbursement for additional monetary losses that were more likely than not caused by the data breach, were actual and unreimbursed, and are not covered by the out-of-pocket category above. You must show you made reasonable efforts to avoid or seek reimbursement for the loss.
Attested Lost Time (up to $80): Reimbursement for up to 4 hours of time spent dealing with the data breach at $20 per hour. You must have spent at least 1 full hour. This can be combined with out-of-pocket losses but is subject to the same $500 cap.
Option 2 — Alternative Cash Payment ($45):
Instead of claiming documented losses or lost time, you can submit a claim for a flat $45 cash payment with no documentation required. This can be combined with a request for credit monitoring. If you choose the $45 cash payment, you cannot also claim out-of-pocket losses, extraordinary losses, or lost time.
Credit Monitoring (2 years, free): Available with any option. You can enroll in 2 years of 3-bureau credit monitoring by selecting the credit monitoring option on the claim form.
