Who Qualifies?
You qualify for this settlement if all of the following apply to you: you are located in the United States, you asked ASP Aesthetics (doing business as Chapter Aesthetic Studio) to stop sending you text messages at any time between April 4, 2021 and February 10, 2026, you received one or more text messages from ASP Aesthetics or its agents to your cell phone after making that opt-out request, and the text messages promoted ASP Aesthetics goods, products, or services.In plain terms: if you told Chapter Aesthetic Studio to stop texting you and they kept texting you anyway, you are likely eligible.
How Much Can You Get?
Up to $55 per qualifying text message, for up to 10 messages, for a maximum of $550 per person.Qualifying text messages are messages you received from Chapter Aesthetic Studio after you requested them to stop sending texts. Each unwanted message counts separately -- so if you received 5 texts after opting out, you could receive up to $275. If you received 10 or more, your maximum is $550.
The final payment amount will be determined by the total number of claims filed. With only 4,891 estimated class members, individual payouts could reach the maximum amounts if a significant portion of the class does not file.
Got Spam Texts From a Different Company?
This settlement only covers texts from ASP Aesthetics / Chapter Aesthetic Studio. But if you are receiving unwanted marketing texts from other companies after you asked them to stop, you may have a separate TCPA claim. How Do I File a Claim?
Submit your claim online at ASPTCPASettlement.com or print the PDF claim form and mail it to the settlement administrator. Your claim must be submitted or postmarked by June 11, 2026.You will need your claim number and PIN from the settlement notice you received, along with the cell phone number that received the unwanted text messages from ASP Aesthetics. If you did not receive a settlement notice but believe you qualify, contact the settlement administrator.
When Will Payments Be Mailed?
