What is the $6M BMW Fraudulent Emissions Class Action?

This $6,000,000 BMW class action lawsuit, known as Rickman v. BMW of North America, alleges that BMW equipped certain diesel vehicles (2009-2013 BMW X5 xDrive35d and 2009-2011 BMW 335d) with something known as a "defeat device" that would have reduced emissions controls while driving certain BMW cars. The BMW class action lawsuit claimed BMW defrauded consumers by developing, advertising, and selling certain BMW vehicles with devices that allowed higher pollution levels during normal operation compared to regulatory testing environments.

BMW denies all allegations made in the lawsuit and opted to settle to avoid the costs and uncertainties associated with further litigation. The Court has yet to determine the validity of the claims made by either party involved in the class action lawsuit.

What is the Total Settlement Amount?

The total settlement amount is $6 million. This Settlement Fund will be used to provide Cash Awards to eligible Settlement Class Members, cover Notice and Administrative Costs, pay Attorneys' Fees and Costs, and provide Service Awards to the Named Plaintiffs, subject to Court approval.

How Do I Qualify for a Payout?

To qualify for a payout, you must be a Settlement class member that purchased or leased certain BMW cars on or before February 28, 2024. Certain individuals are excluded from the Settlement Class, including BMW employees, Class Counsel, judges who presided over the case, and those who have settled or had claims dismissed against BMW related to this issue. How Much Can I Get?

The exact amount each class member can receive is not specified. Cash Awards will be calculated as a pro rata share of the Net Settlement Fund, based on each Settlement Class Member's length of ownership and/or lease of their Class Vehicle. If funds remain after the initial distribution, there may be additional rounds of distributions to those who successfully received their initial payments.
