What Is the Club One Comp Dollars Settlement About?
The Club One comp dollars class action settlement resolves a Nevada lawsuit captioned
Chitwood, et al. v. Circa Hospitality Group, LLC, et al., Case No. A-23-882231-C, in the
District Court of Clark County, Nevada. The case concerns Club One, the players' rewards program
shared by three downtown Las Vegas properties operated by the Circa Hospitality Group entities —
Circa Resort & Casino, The D Las Vegas, and Golden Gate Hotel & Casino.
Club One members earn "comp dollars" — complimentary benefit dollars — that can be redeemed for
things like food, meals, and nonalcoholic beverages at the properties. The lawsuit alleged that
when members redeemed those comp dollars for food and beverages, the defendants reduced the
member's comp-dollar balance by both the menu price and the associated sales tax. The
named plaintiff argued that deducting the sales tax from earned comp dollars deprived Club One
members of the full value of the rewards they had earned. It is part of a broader wave of
consumer cases targeting how loyalty and "junk fee" charges are calculated and disclosed — a theme
that also runs through cases like the Gametime hidden ticket fees settlement.
To resolve the claims, the Circa Hospitality Group defendants agreed to distribute a total of
800,000 comp dollars to the class, divided equally among all qualifying members, and to bring the
Club One program's comp-dollar redemption policies into line with Nevada law. The defendants deny
all allegations of wrongdoing. The court has not found that the defendants did anything wrong; the
parties settled to avoid the cost and uncertainty of further litigation, and the court has approved
the settlement.
Who Qualifies for the Club One Settlement?
The Settlement Class is made up of Club One players' rewards program members who, between
October 23, 2020 and December 31, 2025, redeemed comp dollars at Circa, The D, and/or Golden Gate
in exchange for food, meals, and/or nonalcoholic beverages and had their comp dollars reduced
proportionally to both the menu price and the associated sales tax.
In plain terms, you are likely covered if, during that period, you were a Club One member and used
your comp dollars to pay for a meal or a soft drink at one of the three casinos and saw your
comp-dollar balance drop by the price plus tax. Class members were identified from the defendants'
records and notified directly — if you received a settlement notice, you have been identified as a

What Does the Club One Settlement Provide?
The settlement distributes a total of 800,000 comp dollars (the "Settlement Comp Dollars") to the
Settlement Class. This is not a cash payment — each qualifying member receives an award of comp
dollars credited back to their Club One account. The Settlement Comp Dollars are split
equally among all qualifying members, so every member who stays in the class receives the
same number of comp dollars rather than an amount tied to how much they personally redeemed.
Under the settlement, the comp dollars will be automatically credited to each qualifying member's
Club One account no later than December 31, 2026. There is nothing to fill out — the credit is
applied to the account on file. One important limit applies: the Settlement Comp Dollars are valid
for only nine (9) months from the date they are credited to your Club One account, so plan to use
them before they expire. If your Club One contact or account information has changed, it is worth
confirming it is current with the property so your credit is applied to the right account.
The class representatives may receive a service award, and Class Counsel may receive attorneys'
fees and costs, each subject to court approval. These amounts, along with the costs of settlement
administration, are paid separately — qualifying members are not responsible for any attorneys'
fees, costs, or administration expenses, and those amounts do not come out of your comp dollars.
Do I Need to File a Claim for the Club One Settlement?
No. Unlike many consumer settlements, the Club One comp dollars settlement does not require a claim
form. The court has approved the settlement, and if you are a qualifying class member your comp
dollars will be credited to your Club One account automatically — you do not have to fill out
anything, upload receipts, or enter a claim ID.
The only reason to take action is if you do not want to participate. Class members who
prefer to keep their own legal claims against the defendants can exclude themselves (opt out) by
June 21, 2026. If you do nothing, you stay in the class and receive your comp dollars for free.
When Will the Comp Dollars Be Credited?
The court has approved the settlement. Under the agreement, the Settlement Comp Dollars will be
automatically credited to each qualifying member's Club One account no later than December 31,
2026. Remember that the comp dollars are valid for only nine (9) months after they land in your
account, so it is worth keeping an eye on your Club One balance and using them before they expire.
How Do I Opt Out of the Club One Settlement?
Staying in the class is automatic — if you do nothing, you remain a class member, receive your
comp dollars, and give up the right to sue the defendants over the claims this case resolves. The
only alternative is to exclude yourself (opt out). Excluding yourself means you will not receive any
Settlement Comp Dollars, but you keep any individual claims you may have against the defendants.
To opt out, you must send the Settlement Administrator a written request, postmarked by
June 21, 2026, that includes your name, email, telephone number, and mailing address, plus a
signed and dated statement that you want to be excluded from the Settlement Class in
Chitwood, et al. v. Circa Hospitality Group, LLC, et al., No. A-23-882231-C. The exact
submission instructions are set out in the Class Notice and on the official settlement website.
Important: excluding yourself can carry a hidden cost. While this case is pending, the
statute of limitations on class members' claims is paused, but opting out does not keep that clock
stopped for you — if you exclude yourself and later try to sue on your own, your individual claims
could already be time-barred. Most class members simply do nothing and receive the automatic comp
dollars credit.
Is the Club One Settlement a Scam? How to Stay Safe
Any time a large consumer settlement pays out automatically, scammers send fake "claim your Club
One comp dollars" emails or texts asking you to click a link, log in to a spoofed site, or pay a
fee. A few signals separate the real settlement from a scam:
• The real settlement requires no claim form and no fee. Anyone asking you to pay
money, hand over passwords, or buy gift cards to "release" your comp dollars is running a scam.
• The official settlement website is chitwoodvcircasettlement.com. Comp dollars are
credited directly to your Club One account — there is no separate "credit portal" you must pay to
access.
• If a message asks you to click an unfamiliar or shortened link to receive your Club One
credit, treat it as phishing. Type the official website address into your browser directly to check
your status.
