A settlement has been reached in a class action lawsuit against The Criterion Collection, LLC. The lawsuit claims that Criterion disclosed subscribers personally identifiable information to Twilio, Inc. and Meta Platforms, Inc. without consent in violation of privacy statutes including the Video Privacy Protection Act, the Electronic Communications Privacy Act, the Pennsylvania Wiretapping and Electronic Surveillance Control Act, and the Florida Security of Communications Act. Criterion denies wrongdoing and the Court has not decided who is right. The parties agreed to settle to avoid the uncertainties and expenses of litigation.

Why was this notice issued
A Court authorized this notice so you know about the proposed Settlement and your options before the Court decides whether to grant final approval. Judge Valerie E. Caproni of the Southern District of New York is overseeing the case, Lucchese-Soto, et al. v. The Criterion Collection, LLC, Case No. 1:24-cv-07345-VEC.
What is a class action
In a class action, class representatives sue on behalf of other people with similar claims. The Court resolves the issues for all class members who do not exclude themselves.
What is this action about
Plaintiffs claim Criterion violated VPPA, ECPA, WESCA, and FSCA by disclosing subscribers personally identifiable information to Twilio and Meta without consent. Criterion denies all wrongdoing. The parties reached a Settlement to avoid further risk and expense.
Why is there a Settlement
Both sides agreed to a Settlement to avoid the uncertainty and cost of continued litigation and a trial. Class Members will receive benefits sooner if the Court approves the Settlement.
Settlement Class definition
All Persons in the United States who from September 27, 2022 through December 27, 2024 were a registered user of, or had a subscription to, the Criterion Channel Service and watched a pre-recorded video through the Criterion Channel Service. Criterion Channel Service means criterionchannel.com, the iOS or Android apps, and any other digital platform or application owned and operated by Defendant where video content is available to subscribers, including Roku, tvOS, Android TV, Fire TV, Samsung TV, and Xbox.
Excluded are the presiding Judge and family, Defendant and related entities and personnel, persons who submit a valid and timely exclusion, and their legal representatives and assigns.
What the Settlement provides
Defendant will create a Settlement Fund of $4,500,000. Payments to Class Members, Settlement Administration Expenses, attorneys fees and costs, and Service Awards to Class Representatives will be paid from this fund.
How much will my payment be
Each approved claimant will receive an equal pro rata share of the net Settlement Fund after approved deductions. The final amount depends on the number of valid claims.
When will I be paid
If the Court grants final approval and any appeals are resolved, payments will be issued within sixty days after the Effective Date. Payments will be by check unless you select PayPal or Venmo. Checks expire after 180 days.
If you are an eligible Critereon Collection Class Member, submit a Claim Form by Tuesday, August 19, 2025. You can file online or print and mail a paper form. Filing online is faster, secure, and free.
What rights you give up
If the Settlement becomes final and you do not exclude yourself, you will release the Defendant and related parties from the claims described in the Settlement Agreement. This applies whether or not you submit a claim. You can review the Settlement Agreement on the settlement website.
What happens if you do nothing
You will not receive a payment, and you will give up your right to sue the Defendant about the released claims.
Class Counsel
The Court appointed Bursor and Fisher, P.A. and Levi and Korsinsky, LLP as Class Counsel. You will not be charged by these lawyers. You may hire your own lawyer at your own expense.
Fees and costs
Class Counsel may seek up to one third of the Settlement Fund in fees plus costs and expenses, subject to Court approval. Class Representatives may seek Service Awards up to 2,500 dollars each, subject to Court approval.
How to exclude yourself
To exclude yourself, mail or deliver a signed letter stating that you wish to be excluded from Lucchese-Soto v. The Criterion Collection, LLC, Case No. 1:24-cv-07345-VEC. Include your name, address, signature, and the case name and number. Your request must be postmarked no later than Tuesday, August 19, 2025 and sent to:

How to object
If you are a Class Member and do not exclude yourself, you may object by filing a letter or brief with the Court by Tuesday, August 19, 2025 that states your reasons, includes any legal citations and evidence, and lists the names and contact information of any attorneys who represent or assist you. Include your name, the basis for your Class Membership, and your signature. If you or your attorney have ever objected to a class settlement and sought or received payment for withdrawing that objection without modification to the settlement, you must identify each such case by full caption. The Court will hold a Final Approval Hearing on Wednesday, October 15, 2025 at 2:30 PM ET in Courtroom 20C, Daniel Patrick Moynihan U.S. Courthouse, 500 Pearl St., New York, NY 10007. The Court will decide whether the Settlement is fair, reasonable, and adequate, and whether to approve fees, costs, and Service Awards. The hearing date or time may change.
