What Changed Recently?

Antigo Construction, Inc. and its related companies, Badger State Highway Equipment, Inc., Antigo International Inc. and Antigo MHB Breakers Ltd., agreed to settle Kubacki v. Antigo Construction, Inc., Case No. 2026CV000035, a class action in the Wisconsin Circuit Court for Langlade County. The court authorized notice to the class, and the settlement website is now taking claims.

According to the settlement agreement, the ransomware group DragonForce gained access to the companies’ network between June 1 and June 6, 2025, and claims to have stolen about 104 gigabytes of data. The files potentially contained names, Social Security numbers, driver’s license numbers, financial account numbers and health insurance information belonging to current, former and prospective employees. Antigo discovered the breach on June 6, 2025 and began mailing notices on October 31, 2025. The plaintiff first sued in federal court in Wisconsin in November 2025, then dismissed that case and refiled in Langlade County in March 2026. Antigo denies the claims and any wrongdoing, and the court has not decided who is right.

Who Qualifies?

The settlement class includes every person whose private information was potentially accessed in the data breach. Excluded are Antigo and its parents, subsidiaries, affiliates, officers and directors; anyone who opts out by November 9, 2026; the attorneys for the parties; the judges assigned to the case and their immediate families; and anyone found criminally responsible for the breach.

How Much Can You Get?

Each class member who files chooses one of two cash options:
Payments for documented losses and lost time share a $200,000 aggregate cap; if valid claims in those categories exceed it, those payments are reduced pro rata. A loss claim without acceptable documentation may be converted to the $100 payment. Separately, every class member gets two years of three-bureau credit monitoring with no claim form. Antigo pays attorneys’ fees and costs of up to $145,000, a $2,500 service award and all notice and administration costs separately, so those amounts do not reduce class members’ benefits.

What Proof or Notice ID Is Required?

The online claim form opens with the Notice ID printed above the class member’s name and address on the mailed notice, or the Claimant ID on an emailed notice, together with the class member’s last name. The $100 option needs no documentation. The loss option requires documentation for each expense, such as receipts or statements; self-prepared records alone are not enough. Lost time requires an attestation briefly describing what was done.

What Is the Deadline?


The credit monitoring activation code on the notice must be used within 180 days of the date the notice was mailed, according to the notice.

How Do You Take Action?

Claims are filed through the official Antigo settlement claim form login using the Notice ID and last name. A paper claim form, the notice and the settlement agreement are on the settlement documents page of the website run by the court-appointed administrator, Atticus Administration.

What Happens Next?

The court will decide at the December 14, 2026 hearing whether to grant final approval. Under the notice, if the settlement becomes final, valid claims are paid by mailed check or electronic payment within 45 days of the effective date or within 30 days after the claim is approved, whichever is later. Checks are void 90 days after issuance, and reissue requests are accepted until 180 days after the effective date. No payment date has been announced.
