Etairos Health Data Breach Settlement: $75 or Up to $4,500 for Employees Notified in March 2024

Current and former Etairos Health employees who received the company’s March 2024 notice about a ransomware attack may qualify to claim $75 or up to $4,500 in documented losses, plus three years of credit monitoring, from the Etairos Health data breach class action settlement. Claims are open. The deadline is December 21, 2026, for claims filed online or mailed with a postmark by that date. What Changed Recently?

Etairos Health, Inc., a home health care provider with offices in Largo, Palm Harbor, Fort Lauderdale, Tampa, Orlando and Tamarac, Florida, agreed to settle Bueno v. Etairos Health, Inc., a class action in the Circuit Court for the Sixth Judicial Circuit in and for Pinellas County, Florida. The settlement agreement is dated April 8, 2026, and the court-approved notice program has opened the claim period.

The case followed a ransomware attack on Etairos’ network on or around February 20, 2024. According to the settlement agreement, the attack potentially exposed current and former employees’ names, addresses, government-issued ID, license credentials, phone numbers and/or Social Security numbers. Etairos sent notices on or around March 22, 2024, and the lawsuit was filed that May, asserting negligence and breach of implied contract. Etairos denies the claims and any wrongdoing and agreed to settle to avoid the cost of litigation.

Who Qualifies?

The settlement class is every U.S. resident Etairos sent written notice about the data incident, on or around March 22, 2024. Those notices went to current and former employees whose information was on the network. Etairos told the court the class has about 3,259 people.

Excluded are Etairos and its officers and directors, the judge, the lawyers for both sides, anyone who opts out, and anyone found to have taken part in the attack.

How Much Can You Get?

Class members choose between two cash options, and anyone can add credit monitoring: The $75 payment and the loss-and-time claim cannot both be claimed. The amounts are fixed, not estimates: there is no shared fund, so payments are not reduced by the number of claims. Etairos pays attorneys’ fees and costs of up to $146,500, a service award of up to $3,500 and administration costs separately. The settlement does not pay for emotional distress or bodily injury.

What Proof or Notice ID Is Required?

The online claim form opens only after a class member logs in with the Login ID and PIN printed on the notice. A class member without them can ask the administrator through the settlement website to resend them, using their full name and mailing address. The paper claim form accepts either the notice’s unique identifier or the name and physical address the class member gave Etairos for employment purposes.

The $75 payment, credit monitoring and attested time need no receipts; the time claim needs a signed attestation and a short description. Out-of-pocket losses need documents not prepared by the claimant, such as bills, receipts or card statements. Self-written notes can support a claim but are not enough on their own. Unrelated transactions and all but the first and last four digits of account numbers can be redacted. Every claim is signed under penalty of perjury.

What Is the Deadline?

Claims must be submitted online or mailed with a postmark no later than December 21, 2026. Requests to be excluded and objections are due by November 20, 2026; exclusion requests must be postmarked by that date, and objections must be filed with the Pinellas County Clerk of Court by then. The notice does not specify a time zone.

How Do You Take Action?

File through the official Etairos Health settlement website using the Login ID and PIN from the notice, or download the paper claim form there and mail it with any documents. The website also posts the notice, the settlement agreement and instructions for opting out or objecting.

Class members who choose credit monitoring receive an activation code after the settlement becomes final; the service does not start until they enroll with it.

What Happens Next?

The court will hold the final approval hearing at 9:00 a.m. on January 20, 2027, at the Clearwater Courthouse (Courtroom B, or by Zoom if the court orders). It will also rule on the fee and service-award requests. Etairos may cancel the settlement if 100 or more class members opt out.

If the settlement is approved, it becomes effective after any appeals are resolved, and approved claims are to be paid within 60 days of that date or within 30 days of a claim’s approval, whichever is later. Settlement checks expire 60 days after they are issued.

Questions

Can I claim both the $75 payment and my documented losses?

No. The $75 alternative cash payment replaces the claim for out-of-pocket losses and attested time; a class member picks one or the other. Credit monitoring can be added to either choice.

Will the attorneys’ fees reduce my payment?

No. Etairos pays attorneys’ fees and costs of up to $146,500, a service award of up to $3,500 and the cost of notice and administration separately. There is no shared fund, so valid claims are not reduced because others file.

I lost my notice. Can I still file?

The online claim form requires the Login ID and PIN printed on the notice, and the settlement website says the administrator can resend them if a class member provides their full name and mailing address.
