EpiPen Class Action Settlement Additional Payments

Published: January 26, 2026

EpiPen Settlement Payments Are Closed, But Some Claimants Report More Money Received

Some EpiPen class action settlement claimants are now reporting what appear to be additional payments beyond the initial distribution back in 2023. As of early 2026, some consumers are reporting repeating second payments from the EpiPen settlement.

The EpiPen settlement is closed to new claims, and OpenClassActions.com is not the settlement administrator. If you received a payment, or believe you may receive another payment, the only reliable confirmation is what you receive directly from the official settlement payment process and claim website.

Settlement Status

Settlement Status: Payments Sent
Claim Form Deadline: Passed
Proof Required: No (for many claimants)
Method of Payment: Digital payment portal or mailed check, depending on how the claimant was processed

Update: What We Know About Possible Second Payments

Some claimants have reported receiving additional settlement funds after the first wave of payouts. In most large class actions, it is possible for additional distributions to occur if money remains in the fund after the initial payments, claims corrections, returned checks, payment failures, or other administrative adjustments.

However, an additional payment is not guaranteed for every claimant. Payment timing and amounts can vary by claimant and may depend on the number of valid claims, administrative review outcomes, and remaining settlement funds.

If you previously received an EpiPen settlement payment, the safest assumption is that you should not expect a second payment unless you receive an official payment notice tied to your claim.

Important Email to Watch For

Claimants have previously been instructed to look for emails related to payment processing. If you filed a claim, monitor the same email address you used on your claim form for messages that appear to come from the official settlement payment system.

Always double check links before entering personal information. If something looks off, go directly to the official claim website in your browser rather than clicking from an email.

How Were Payments Issued?

Based on prior settlement instructions and claimant reports, payments were distributed through a digital payment portal that could offer options like PayPal, Venmo, direct deposit, or a virtual prepaid card. Some claimants may have received a mailed check depending on the payment method used for their claim.

If additional payments are occurring, they may use the same method previously selected by the claimant, but this can vary depending on administrator procedures.

What Is the EpiPen Settlement About?

A $264,000,000 settlement fund was created in litigation involving allegations that certain EpiPen products were priced or marketed in a way that harmed competition and caused consumers and third party payors to overpay. Defendants denied wrongdoing but agreed to settle to avoid the cost and risk of continued litigation.

This settlement is closed to new claims.

How Did Claimants Qualify?

In general, the settlement defined qualifying class members as people or entities in the United States who paid for, or provided reimbursement for, some or all of the purchase price of certain EpiPen products for the purpose of consumption and not resale during the class period described in the settlement.

Some states were treated differently for certain categories, and the settlement website and official notices controlled those definitions.

Do I Need To Do Anything To Get An Additional Payment?

In many settlements, additional distributions are processed automatically for eligible, approved claimants. That said, the settlement administrator controls the process, and requirements can vary.

If you receive an email asking you to choose a payment method again, verify that it is actually connected to the official settlement website. If you are not sure, do not provide information through a link you do not trust.

Scam Warning

Settlement related scams are common. Be cautious of messages that:

• Ask for your Social Security number to "release" your payment
• Demand a fee to receive settlement money
• Threaten you with penalties if you do not respond immediately
• Use look alike domains or misspellings

When in doubt, go directly to the official settlement site and use the official contact information listed there.
