The lawsuit alleged that Evry Jewels Inc. advertised discounts on Evryjewels.com deceptively — presenting reference prices and markdowns that plaintiffs said did not reflect genuine former prices, in violation of consumer protection laws in California, Oregon and Washington. The settlement provided $14 per qualifying order. A class member who submitted a claim could choose a cash payment. A class member who did nothing automatically received store credit instead — credits that, under the settlement terms, can be used on any purchase, never expire, stack with other credits and discounts, and are transferable. One claim form covered all of a person's qualifying orders.The parties estimated the total value of the cash and credit benefits at approximately $3,500,000, based on roughly 250,000 qualifying orders at $14 each. Evry Jewels separately agreed to pay notice and administration costs estimated at $65,000, service awards of up to $5,000 each to the class representatives, and up to $875,000 in attorneys' fees and expenses. Those amounts were not deducted from the $14 per-order benefit.
What Proof Was Required?
No receipts or document uploads were required. Claimants attested under penalty of perjury that they had placed one or more qualifying orders while in California, Oregon or Washington during the class period, that they were in the settlement class, and that they had not opted out. Filing online could require a PIN or unique ID from the mailed notice; the printable paper claim form did not require one, and store credit arrived with no claim at all.What Happens Next?
