What Is the Fandango Class Action Settlement About?

Did you buy movie tickets to a California theater through Fandango between June 2020 and June 2024, or buy a Fandango FanClub membership in California or Washington between October 2024 and April 2025? You may be eligible for a $3.25 cash payment or voucher, a $7.50 FanClub voucher, or both, from a class action settlement with combined estimated benefits of $9.4 million.

The Fandango class action lawsuit, captioned Jonathan Beer et al. v. Fandango Media, LLC, Case No. 25CU046749N, is pending in the Superior Court of California for the County of San Diego before the Honorable Cynthia Freeland. Named plaintiffs Jonathan Beer and Thalia Calo Gonzalez allege that Fandango (1) failed to timely disclose a mandatory Convenience Fee for online movie ticket purchases to California theaters, in violation of California consumer protection law, and (2) violated certain laws by selling FanClub memberships with monthly credits that expired after 30 days, in violation of California's Gift Card Law and related statutes.

Fandango denies any wrongdoing and is settling without admitting liability. The Settlement Administrator is Epiq. The official Settlement Website is at fandangomediasettlement.com.

The Two Fandango Settlement Classes Explained

One of the unusual features of this settlement is that it covers two separate classes of consumers with different eligibility windows and different benefits. You can be in one class, both classes, or neither.

If you are in both classes, you can stack the benefits. Members of both classes receive (1) either a $3.25 cash payment (with a Claim Form) or a $3.25 voucher (automatic), AND (2) a $7.50 FanClub voucher (automatic). Stacking is allowed by the settlement design; you do not have to choose one class over the other.

30-Second Self-Test: Do I Qualify for the Fandango Settlement?

Answer the questions below to determine which class you may be in.

Question 1 (Convenience Fee Class): Between June 11, 2020 and June 17, 2024, did you buy movie tickets online through Fandango (Fandango.com or the Fandango app) for a California theater AND pay a Convenience Fee on the order?

• If yes, you are likely a Convenience Fee Class Member, unless you are subject to binding arbitration with Fandango (most consumers are not).

Question 2 (FanClub Class): Between October 7, 2024 and April 16, 2025, did you purchase a Fandango FanClub membership while a California or Washington consumer?

• If yes, you are likely a FanClub Class Member.

Answer yes to both: You are likely in both classes and can stack the benefits ($3.25 cash or voucher PLUS $7.50 voucher).

The Settlement Administrator (Epiq) sent email notices to consumers identified from Fandango's records as likely class members. If you received a notice email from Epiq, you are very likely in at least one of the two classes.

How to Find Your Fandango Settlement Unique ID and Confirmation Code

The Cash Option ($3.25) requires you to submit a Claim Form with a Unique ID and Confirmation Code from the Email Notice sent by Epiq. If you cannot find your Email Notice, here is how to recover your codes.

Step 1: Search your email. Look for an email from Epiq (or a settlement administrator email address) about the Beer v. Fandango Media settlement. Check your inbox, spam folder, promotions tab, and any other folders where commercial email might be filed. The email should contain your Unique ID and Confirmation Code prominently displayed.

Step 2: Use the Unique ID Lookup tool. If you cannot find the email, visit the official Settlement Website's Unique ID Lookup page and enter the email address associated with your Fandango account. If your email is in the class data, the system will display your Unique ID and Confirmation Code.

Step 3: File a paper Claim Form by mail. If your email is not found in the lookup system but you believe you qualify (for example, you used a different email address for Fandango than the one on file, or you have evidence of a qualifying purchase), you can download a paper Claim Form from the Settlement Website and mail it to the Settlement Administrator with supporting information.

Important: Vouchers ($3.25 Convenience Fee Class voucher or $7.50 FanClub voucher) are issued AUTOMATICALLY by Fandango based on its records, without any claim form or Unique ID required. You only need the Unique ID and Confirmation Code if you want the $3.25 CASH option instead of the automatic voucher.

What Are the Fandango Settlement Allegations?

The Beer v. Fandango complaint raises two distinct sets of allegations.

1. Convenience Fee non-disclosure. Plaintiffs allege that Fandango charged consumers a mandatory Convenience Fee when buying movie tickets online for California theaters, but did not disclose the fee at the start of the purchase flow as required by California consumer protection law. California has been increasingly aggressive about requiring up-front pricing disclosure for online consumer transactions, with California Senate Bill 478 (the "Hidden Fees Statute") taking effect in July 2024 to require all mandatory fees to be disclosed in advertised prices. The Beer complaint covers fees charged BEFORE the July 2024 law took effect, under prior California consumer protection statutes.

2. FanClub credit expiration. Plaintiffs allege that Fandango's FanClub membership program offered $10 monthly credits that expired 30 days after issuance, in violation of California's Gift Card Law (which generally prohibits gift certificates from expiring). The complaint also raises claims under California's False Advertising Law, Consumers Legal Remedies Act, Unfair Competition Law, and the federal Credit Card Accountability Responsibility and Disclosure Act of 2009 (the CARD Act).

Fandango denies all allegations and is settling without admitting liability. The Court has not ruled on the merits of the claims; the settlement is intended to avoid the cost and uncertainty of continued litigation.

Cash or Voucher? Which Should I Choose?

Convenience Fee Class Members have a real choice to make: $3.25 cash (requires a Claim Form) or $3.25 voucher (automatic, no action required). The dollar amount is the same, but the trade-offs differ.

Pick the Cash Option ($3.25) if:

• You want real money, deposited to your bank or sent as a check
• You do not plan to buy movie tickets through Fandango in the next three years
• You can find your Unique ID and Confirmation Code (or recover them via the lookup tool) and submit the Claim Form by August 17, 2026
• You no longer want to use Fandango as a service and prefer cash on principle

Pick the Voucher Option (automatic, $3.25) if:

• You routinely buy movie tickets through Fandango.com or the Fandango app and will use the voucher within three years
• You cannot find your Unique ID and Confirmation Code and do not want to deal with the paper claim form process
• You prefer the zero-effort path (the voucher is sent automatically; you do not have to do anything)

For the $7.50 FanClub voucher, there is no choice to make. FanClub Class Members automatically receive the $7.50 voucher with no expiration date and no claim form needed. There is no cash alternative for the FanClub portion of the settlement.

How to Use the Fandango Voucher

Both the $3.25 Convenience Fee Class voucher and the $7.50 FanClub Class voucher come with the same restrictions on use.

Where: Fandango.com or the Fandango mobile app only. The vouchers CANNOT be redeemed directly at any theater box office.
What: Movie tickets purchased through Fandango. The vouchers can also be used to pay any applicable taxes on the purchase.
Stacking: Vouchers cannot be combined or stacked with any other discount or offer. You generally cannot use the voucher together with another promo code.
Transferability: Vouchers are NOT transferable to another person or account.
Partial redemption: If a voucher's face value exceeds the order total (including taxes), the unused portion remains available for use on future Fandango orders. The vouchers are not all-or-nothing.
Expiration: Convenience Fee Class vouchers ($3.25) expire 3 years after issuance. FanClub Class vouchers ($7.50) do NOT expire.

How to File the Fandango Cash Option Claim in 2026

Only the $3.25 Cash Option requires a Claim Form. Vouchers (both types) are issued automatically.

Method 1: Online (recommended). Visit fandangomediasettlement.com. Click "Submit a Claim" and log in with your Unique ID and Confirmation Code from your email notice (or recover them via the Unique ID Lookup tool with your email address). Complete the Claim Form, indicate your preference for check or electronic payment, and submit by 11:59 p.m. on August 17, 2026. You will receive a confirmation email with a tracking number.

Method 2: U.S. Mail. Download the paper Claim Form from the Documents section of the Settlement Website. Complete it with your contact information, the Unique ID and Confirmation Code from your email notice (if you have them), and your signature. Mail the completed form to the Settlement Administrator at the address printed on the form. Mailed claims must be postmarked by August 17, 2026.

Before you file, gather: the email address associated with your Fandango account (for the lookup tool), your Unique ID and Confirmation Code (from the email notice or recovered via the lookup), and your preferred payment information (check mailing address or electronic payment account details).

Important sequencing note: The Claim Form deadline (August 17) is 10 days AFTER the Final Approval Hearing (August 7). This is unusual for class action settlements. The reason is that the default benefit for class members who do nothing is an automatic voucher; the Cash Option is the affirmative opt-in. The court can approve the settlement before all individual cash elections are processed because the default outcome (voucher distribution) is unaffected by claim form returns.

When Will I Get My Fandango Settlement Payment or Voucher?

Payment and voucher distribution timing depends on the Court's final approval and any appeals.

Distribution begins: typically several weeks to several months after the settlement becomes final

Vouchers are typically delivered electronically via promo code to the email address on file with Fandango. Cash Option payments are delivered by check (mailed to the address on the Claim Form) or by electronic payment, depending on the option you selected on the form.

What Happens If I Do Nothing?

If you do nothing AND you are a Convenience Fee Class Member, you will automatically receive a $3.25 voucher after the settlement becomes final, but you will NOT receive the $3.25 cash option.

If you do nothing AND you are a FanClub Class Member, you will automatically receive a $7.50 voucher after the settlement becomes final. (There is no cash alternative for the FanClub portion.)

If you are in both classes and do nothing, you automatically receive both the $3.25 voucher and the $7.50 voucher.

Doing nothing also means you give up the right to sue Fandango about the issues in this lawsuit. You will be legally bound by the Court's orders and judgments in this class action. To preserve the right to sue Fandango separately for the Convenience Fee or FanClub claims, you would need to formally opt out by June 18, 2026.

How to Opt Out or Object to the Settlement

Class members who do not want to be bound by the settlement have two alternatives, both with the same June 18, 2026 deadline.

Opting out (excluding yourself). Opt-out means receiving no settlement benefits (no cash, no voucher) but preserving your right to file your own lawsuit against Fandango over the Convenience Fee or FanClub claims. Opt-out requests must be in writing, postmarked by June 18, 2026, and mailed to the Settlement Administrator at the address printed on the Settlement Notice. The request must include your full name, address, phone number, email address (for class data matching), and original personal signature, along with a specific exclusion statement tied to your class. To opt out of both classes, the request must include both class-specific exclusion statements. Only individual exclusion requests are accepted; group exclusions are not allowed.

Objecting. Objection means staying in the class (and remaining eligible for the cash payment or voucher) but asking the Court to reject or modify the settlement. Written objections must be filed with the Court and copies served on Class Counsel and Defense Counsel, all postmarked by June 18, 2026. Objections must include your name, address, phone number, the case caption, written grounds for objection with any supporting legal authority, copies of supporting documents, a statement of whether you intend to appear at the Final Approval Hearing, proof of class membership with a sworn statement, a list of other class action settlement objections from you or your counsel in the last three years, and signatures.

Watch Out for Fandango Settlement Scams

Movie ticket and entertainment-brand settlements attract scams because the brand is widely recognized and class periods can be broad. A few common-sense rules:

Use the official Settlement Website only: fandangomediasettlement.com. Bookmark it and type the URL directly. Be cautious of any email or text linking to a "Fandango settlement" page from a different domain.
Never pay a fee. Legitimate class action settlements never require an activation fee, processing fee, or shipping fee. Anyone asking for payment to "release" your Fandango settlement benefit is running a scam.
Never share your Fandango account password or full credit card number with anyone claiming to handle your settlement claim by phone, text, or email. The Settlement Administrator does not need your account password.
The Unique ID Lookup tool is on the official site only. If someone offers to "look up" your Unique ID through a third-party service, it is not legitimate. Use only the lookup tool at fandangomediasettlement.com.
Be wary of "your Fandango refund is waiting" emails from unfamiliar senders. Verify by going directly to the official Settlement Website.
