What Is the Kaiser Spam Text TCPA Settlement About?

You may be part of a new $10.5 million class action settlement reached with Kaiser Foundation Health Plan, Inc. doing business as Kaiser Permanente, over allegations that Kaiser continued to send spam marketing text messages after people replied with STOP or a similar opt out instruction.

The lawsuit claims Kaiser violated the Telephone Consumer Protection Act, known as the TCPA, and the Florida Telephone Solicitation Act, known as the FTSA, by sending more than one text message in any 12 month period between January 21, 2021 and August 20, 2025, to cellular phone numbers after consumers opted out from receiving such solicitations.

Kaiser denies all wrongdoing and does not admit liability. The Court has not decided who is right. Instead, both sides agreed to settle to avoid the cost and risk of continued litigation and to provide cash payments to consumers who submit valid claims.

Who Is Included in the Settlement?

There are two Settlement Classes, both limited to texts sent between January 21, 2021 and August 20, 2025.

TCPA (Telephone Consumer Protection Act) Class

All people in the United States who

1) were sent more than one text message by or on behalf of Kaiser within any 12 month period,
2) regarding Kaiser goods or services, to that person’s cellular telephone number, and
3) after the person told Kaiser that they did not wish to receive text messages by replying to the messages with STOP or a similar opt out instruction.

FTSA (Florida Telephone Solicitation Act) Class

Anyone in Florida who:

1) was sent more than one text message by or on behalf of Kaiser,
2) regarding Kaiser goods or services, to that person’s cellular telephone number, and
3) after the person texted STOP to Kaiser at least 15 days before the text message was sent.

If you received a notice by mail or email, it is because your number appears in Kaiser’s records and you may be a member of one or both classes.

What Is the Total Settlement Amount?

Kaiser has agreed to make up to $10,500,000 available in a common Settlement Fund. This fund will be used to pay

• Cash payments to Settlement Class Members who file valid claims
• Notice and administration costs
• Attorneys fees and costs approved by the Court
• Any service award approved for the class representative

If any money remains after all payments are issued, the remaining balance will be returned to Kaiser rather than sent as a second round of payments or donated as a cy pres award.

How Do I Qualify for a Payout?

To qualify, you must be a member of the TCPA STOP Class, the FTSA STOP Class, or both. In practical terms, that means all of the following must be true:

• You received Kaiser marketing text messages between January 21, 2021 and August 20, 2025
• You replied STOP or sent a similar opt out request to Kaiser
• Kaiser then sent you more than one additional marketing text within a 12 month period after your opt out, or after at least 15 days in Florida for FTSA claims

You do not need to remember the exact dates or number of texts. The Settlement Administrator will use Kaiser’s internal text records to determine whether you are in the class and how many qualifying messages you received.

How Much Can I Get Paid?

Settlement Class Members who submit a timely, valid, complete, and verified claim form will receive up to $75 per Qualifying Text Message.

A Qualifying Text Message is defined as a marketing text sent after a STOP or similar opt out request. A single confirmation text acknowledging your opt out does not count as a Qualifying Text Message.

Because the total fund is capped, your payment may be reduced if the number of valid claims is high. In that case, everyone’s per text amount will be reduced on a pro rata basis so that total payments, plus fees, costs, and any service award, do not exceed $10.5 million.

Do I Need Proof to File a Claim?

No supporting documents are required to file a claim.

The Settlement Administrator will use Kaiser’s text messaging records to confirm whether your number received qualifying texts and to calculate how many qualifying messages are tied to your claim.

Before you file your claim online:

You will need the Unique ID and PIN that appear on the notice you received by mail or email. You enter those codes on the online claim form to pull up your record.

If you did not receive a Unique ID and PIN, or you lost them, you can download, print, and complete a paper claim form instead and mail it to the Settlement Administrator. A blank paper claim form is available on the official settlement website’s Documents page.

You must still certify that the information you provide is true and correct under penalty of perjury. Submitting false information can lead to rejection of your claim and may carry legal penalties.

How Do I File a Claim?

You can file in one of two ways:

1. Online claim filing
• Visit the official website at KaiserTCPASettlement.com
• Enter the Unique ID and PIN from your postcard or email notice
• Review your information, answer the questions on the form, and submit your claim

2. Paper claim form
• Download it from the Documents page of the settlement website
• Fill it out completely, sign it, and mail it to the address listed on the form
• Your envelope must be postmarked no later than February 12, 2026 at 11:59 p.m. Eastern

Only one claim form can be submitted per Settlement Class Member. That single claim will cover all Qualifying Text Messages sent to any of your phone numbers.

What Is the Claim Form Deadline?

The deadline to submit your claim online or to mail a paper claim form is February 12, 2026. Online claims must be submitted by 11:59 p.m. Eastern. Mailed claims must be postmarked by that date and time.

How Many People Are Affected?

The notice does not state an exact class size, but the Settlement Classes cover all United States residents and Florida residents who received more than one Kaiser marketing text in a 12 month period after replying STOP during the class period. Given Kaiser’s size as a national health plan, the classes likely include many thousands of consumers whose numbers appear in Kaiser’s texting systems.

Important Dates

Here are the key deadlines and hearing date from the court approved notice:

Opt out deadline: December 29, 2025 • Objection deadline: December 29, 2025
Claim filing deadline: February 12, 2026
Final Approval Hearing: January 28, 2026 at 3:30 p.m. Eastern

The hearing will be held via Zoom before Judge Mavel Ruiz in the Circuit Court of the Eleventh Judicial Circuit in and for Miami Dade County, Florida. The date and time can change by court order, and any changes will be posted on the settlement website.

When Will the Class Action Settlement Payments Be Sent?

No payments will be made until:

• The Court grants final approval to the settlement at or after the January 28, 2026 hearing, and

• Any appeals are resolved and the settlement becomes final and no longer subject to appeal

The notice explains that appeals can take more than a year. Because of this, there is no exact payment date yet. Payments will be issued only after the settlement is fully and finally approved and all appeals, if any, are completed.

What Are My Options?

You have four basic options:

Submit a claim form. This is the only way to receive a cash payment from the settlement.

Exclude yourself. Also called opting out. You must mail a written request postmarked no later than December 29, 2025. If you opt out, you will not receive money from this settlement, but you keep your right to sue Kaiser separately over the same issues.

Object. If you stay in the Settlement Classes, you can file a written objection by December 29, 2025, telling the Court what you do not like about the settlement. You can also ask to speak at the Final Approval Hearing.

Do nothing. You give up your right to sue Kaiser later over the same telemarketing claims, and you will not receive a payment.

How Do I Opt Out of the Kaiser Settlement?

To exclude yourself, you must mail a letter that clearly states you want to be excluded from the settlement in Jonathan Fried v. Kaiser Foundation Health Plan, Inc., d/b/a Kaiser Permanente, Case No. 2025-016220-CA-01.

Your request must include:

• Your name and address

• Your current phone number and any phone numbers at which you received Kaiser texts

• A statement that you wish to be excluded from the Settlement Classes in this action

• Your signature

Mail your opt out request, postmarked no later than December 29, 2025

You cannot opt out by phone, email, or fax. Mass opt out requests are not allowed. If you opt out, you will not receive any money from this settlement and you cannot object to it.

How Do I Object to the Settlement?

If you stay in the Settlement Classes and do not opt out, you can object if you think the settlement is unfair or inadequate.

To object, you must:

• File a written objection with the Court no later than December 29, 2025, and

• Mail a copy of your objection to the Settlement Administrator by the same date

Your objection must include, among other things:

• The case name and number

• Your name, address, phone number, and signature

• The phone number that received Kaiser texts

• A statement of your specific objections with a detailed factual and legal basis

• Information about any witnesses or documents you want the Court to consider

• The name and contact information of any attorney who will represent you

• A list of any other class action settlements you have objected to in the last five years

• A statement indicating whether you or your attorney intend to appear at the Final Approval Hearing
