What is this class action about?

You may be part of a new $200,000 class action settlement reached with a popular "keto" company over allegations that Ultra Fast Keto Boost, Instant Keto, and InstaKeto products were marketed in a false or misleading way.

The keto pills class action lawsuit alleged that the products were marketed in a false or misleading way. The settling parties denyanny wrongdoing. The settlement avoids the cost and risk of continued litigation and requires cooperation that may assist plaintiffs in a related lawsuit in Florida against other defendants.

What Are Keto Pill Supplements?

“Keto pills” are dietary supplements marketed to support or mimic the ketogenic diet, which is a low-carb, high-fat eating plan.

They are usually advertised as “fat-burning” products that increase levels of ketones in the body.

Typical ingredients include exogenous ketones (like BHB salts), caffeine, or herbal extracts.

The idea is that they might help the body enter ketosis (a state where the body burns fat instead of carbs for fuel).

However, most keto pill products are not clinically proven to be effective, and many have been criticized for misleading marketing claims.

Which Keto Pills are Part of the Class Action?

The keto pills that are part of the settlement include:

Ultra Fast Keto Boost
Instant Keto
InstaKeto

What is the Total Settlement Amount?

The settlement totals $200,000 and is designated for class notice, administration, attorney fees and expenses, and any service awards approved by the Court. It does not fund payments to individual class members.

How Do I Qualify For a Payout?

This settlement does not provide direct compensation to Class Members, but instead provides the following:

Monetary Payment for Costs: A $200,000 settlement fund, which will be used to cover notice costs, claim administration expenses, attorney fees, and service awards to Class Representatives. No direct monetary payments will be made to Class Members.

Injunctive Relief: The settlement includes injunctive relief against two of the defendants, preventing certain actions related to the marketing of the Keto Products.

Evidentiary Cooperation: The settling defendants will provide evidence to assist in a related class action lawsuit in Florida (Sihler et al. v. Global E-Trading, LLC), which aims to obtain compensation for the class.

What Does the Keto Settlement Actually Provide?

This settlement does not provide direct payments. Potential monetary recovery may be pursued in the related Florida case titled Sihler et al. v. Global E-Trading, LLC (d/b/a Chargebacks911) et al., No. 8:23-cv-1450 (M.D. Fla.), where you may receive a separate notice.
