What Is This Settlement About?
Onsite Mammography, LLC, doing business as Onsite Women's Health, has agreed to a proposed $2,525,000 all-cash settlement to resolve a class action over a data security incident that occurred on or about October 2024. According to the notice, an unauthorized third party gained access to one Onsite employee's email account. An investigation determined that files in that account may have included class members' personally identifiable information (PII) and protected health information (PHI) — together called "Private Information."
The lawsuit, captioned Clarkson, et al. v. Onsite Mammography, LLC, d/b/a Onsite Women's Health, asserts claims including negligence, breach of implied contract, breach of fiduciary duty, invasion of privacy, and unjust enrichment. Onsite denies any wrongdoing and denies that it has any liability, but it has agreed to settle to avoid the cost and risk of continued litigation. The settlement is not yet final — the Court still has to approve it at a hearing scheduled for September 9, 2026.
Who Qualifies?
The Settlement Class includes all individuals residing in the United States whose Private Information may have been impacted by the incident and who received written notice from Onsite that their information may have been affected. If you got a notice letter about the Onsite Women's Health email-account breach, you are almost certainly a class member.
Excluded from the class are Onsite and its affiliates, officers, and directors; the judges presiding over the case and their families; anyone who timely opts out; anyone whose claims have already been finally adjudicated or released; and the legal representatives, successors, and assigns of any excluded person.
How Much Can You Get?
Settlement Class Members who submit a valid claim can choose from the following benefits:
• Reimbursement for Out-of-Pocket Losses — up to $5,000 per person for unreimbursed costs, losses, or expenditures fairly traceable to the incident and incurred on or after October 2024. This option requires supporting documentation (for example, records of bank fees, credit-freeze costs, postage, mileage, or credit monitoring you paid for), plus a brief description of what the documentation shows.
• Pro Rata Cash Payment — in addition to, or instead of, out-of-pocket reimbursement, you may elect a flat pro rata cash payment. The amount will be increased or decreased depending on how many valid claims are approved. It is paid from whatever remains in the Settlement Fund after notice and administration costs, taxes, service awards, attorneys' fees and expenses, approved out-of-pocket claims, and approved monitoring claims.
• Credit and Medical/Healthcare Data Monitoring and Insurance Services (CMIS) — you may elect three years of CMIS, equivalent to CyEx Medical Shield Complete, which includes three-bureau credit monitoring and $1 million in identity theft insurance. These benefits are available regardless of whether you took advantage of any earlier credit monitoring offer from Onsite, and you can postpone activation for at least 12 months.
How Do You File a Claim?
To receive a benefit, you must complete and submit a Claim Form for that benefit. Claim Forms are available online at the official settlement website, and a postcard with a tear-off Claim Form was mailed to class members as part of the notice. Read the instructions carefully, complete the form, attach any required documentation, and submit it by the deadline.

If you do nothing, you will not receive any payment or monitoring, and you will give up your right to sue Onsite over the incident if the settlement is approved. To keep the right to sue separately, you must opt out by the exclusion deadline.
When Will Payments Be Made?
Payments will only be made if the Court grants final approval at the September 9, 2026 hearing and after any appeals are resolved. That process can take time — potentially more than a year — and it also takes time to process all the claim forms. Class Counsel will ask the Court for attorneys' fees of up to one-third of the Settlement Fund plus expenses not to exceed $30,000, subject to court approval.
