What Is the PHH Mortgage Insurance Settlement?

You may be part of this class action settlement if you obtained certain mortgage loans. The case was settled with PHH Corp., PHH Mortgage Corp., PHH Home Loans, and Atrium Insurance Corp. over allegations that captive mortgage reinsurance arrangements produced unlawful kickbacks tied to private mortgage insurance (PMI) on loans PHH originated or acquired between 2007 and 2009, in alleged violation of the Real Estate Settlement Procedures Act (RESPA). Defendants deny wrongdoing. The settlement provides a flat cash payment per eligible loan.

The court granted final approval of the settlement on December 19, 2025, and the claim window is open. The case is Munoz, et al. v. PHH Corp., et al., No. 1:08-cv-00759-MMB-BAM, in the U.S. District Court for the Eastern District of California.

Successors, heirs, and assigns are included.

How Much Can I Get Paid?

Approved settlement class members receive an $875 payment per eligible loan, from a settlement fund of approximately $29.5 million. The agreement does not cap individual payments at the loan level; payments are subject to court-approved fees, costs, and administration.

How Do I File a Claim?

File online at PHHMISettlement.com or mail a completed paper form to the administrator by the deadline. To file online you log in with the Unique ID and PIN printed on your mailed notice.
