What Changed Recently?

The settlement resolves Bruns, et al. v. Avondale Apartments, LLLP, et al., Case No. 2025CV32021, in the Denver District Court, Division 424. The tenants who brought the case alleged that residents of the Avondale Apartments were subjected to violations of Colorado’s warranty of habitability, the Colorado Fair Housing Act and their leases because of poor living conditions and inoperable elevators from June 6, 2022 onward. The defendants are Avondale Apartments LLLP, Del Norte Neighborhood Development Corporation, Silva Management Partners, LLC, and Ross Management LMG LLC, which does business as Ross Envolve. The court has not decided whether the allegations are true.

The court granted preliminary approval in an order filed October 13, 2026, certified the class and subclass for settlement purposes and approved CPT Group, Inc. as the settlement administrator. Notice has been mailed to class members.

Who Qualifies?

The Avondale Class is everyone who leased a residential unit at the Avondale Apartment complex on West 14th Avenue in Denver at any time between June 6, 2022 and November 3, 2026, plus the adult members of their households who were named on the lease, had a right to live in the unit and were adults as of November 3, 2026.

The Fair Housing Subclass is every Avondale Class member who is handicapped as the Colorado Fair Housing Act defines the term and whose handicap affects their mobility or ability to go up or down stairs. Subclass members are also in the main class and receive both payments if their claim is accepted.

How Much Can You Get?

The total settlement is $2,000,000, which includes attorneys’ fees, expenses, administration costs and service payments. Class counsel intend to ask for $666,666.67 in fees, one-third of the fund, plus about $4,500 in expenses, and the four class representatives will request $7,500 each. What remains is split among class and subclass members pro rata based on each person’s length of tenancy. No per-person estimate has been published.

Payments are issued by check and mailed. Any money that cannot be distributed goes to the court-approved cy pres recipients, the Colorado Lawyer Trust Account Foundation and the Community Economic Defense Project.

The notice also warns that a payment could affect public benefits. It says people receiving SSI, SSDI, Old Age Pension, Aid to the Needy Disabled, SNAP, Medicaid or TANF generally must report the payment to the agency, and that it could affect eligibility for a month or longer depending on the program.

What Proof or Notice ID Is Required?

None for the main payment: members of the Avondale Class who do nothing are paid automatically if the settlement is approved, so OCA lists this settlement as Automatic Payment.

The Fair Housing Subclass is different. To be considered, a class member must complete the subclass claim form and include medical documentation of the specific handicap. The online form on the settlement website logs in with the CPT ID and passcode printed on the mailed notice; the form can also be emailed or mailed to the administrator, whose contact details are on the settlement website. Within 14 days of a complete claim, the administrator says whether it was accepted, rejected or needs more information.

What Is the Deadline?

Fair Housing Subclass claim forms must be submitted online, emailed or postmarked by January 2, 2027. Opt-out forms are due by the same date, emailed, submitted online or postmarked, and written objections must be submitted to the settlement administrator or filed with the court by January 2, 2027. Class members can also state an objection in person at the final approval hearing. The main class has no claim deadline.

How Do You Take Action?

Main-class members do not need to act to be paid. The official Avondale settlement website has the Fair Housing Subclass claim form, the notice and opt-out form, the court documents and the important dates.

What Happens Next?

The Denver District Court will hold the final fairness hearing on March 4, 2027 at 1:30 p.m. Mountain Time in Courtroom 424, where it will decide whether to approve the settlement, the fee request and the service payments. Checks are mailed only after final approval. Class counsel are DeGolia Law P.C. and Milstein Turner, PLLC, and CPT Group, Inc. is the settlement administrator.
