What Was the Crumbles Litigation About?

Consumers alleged that Daily Harvest French Lentil + Leek Crumbles sold in 2022 caused liver, gallbladder, gastrointestinal, and other injuries. The litigation connected the reported illnesses to tara flour used in the product and asserted claims against several entities involved in making or supplying the Crumbles. Those allegations were disputed. The settlements resolved covered claims without requiring the settling defendants to admit that they caused an injury or violated the law.

What Did Smirk's and Molinos Agree To?

Smirk's Limited and Molinos Asociados agreed to fund a separate $7,671,100 settlement. The agreement addressed claims asserted against them in the consolidated Crumbles litigation. It followed an earlier settlement with Daily Harvest and Stone Gate Foods, but the funds and releases were distinct. The Smirk's–Molinos settlement received preliminary approval in October 2024, notice was sent, the claim period ended in January 2025, and the court entered final judgment in March 2025.

Who Could Qualify?

The settlement generally covered U.S. residents who purchased or consumed the recalled French Lentil + Leek Crumbles and asserted qualifying personal-injury or related claims. Benefit eligibility depended on the category of injury, medical documentation, and the settlement program's claim-review standards. A person who merely heard about the recall did not automatically qualify for a cash award. The detailed class definition and releases were set out in the settlement notice and agreement.

What Benefits Were Available?

The former claim materials described scheduled benefits that varied substantially with the alleged injury. Lower-tier claims could receive amounts beginning around $165, while documented claims involving particular medical treatment or severe injury could be valued much higher, including amounts cited up to $43,330. Those figures were category values, not guaranteed checks. Approved awards could depend on documentation, prior payments, lien resolution, fund limits, and the administrator's final determination.

What Proof Was Required?

Claims for medical injury required supporting material appropriate to the benefit category, such as proof of purchase or consumption and medical records connecting treatment to the relevant time period. The administrator was authorized to review submissions, request more information, reject unsupported claims, and calculate benefits under the agreement. The January 21, 2025 deadline applied to those submissions and is not being reopened by this update.

How Did the Earlier Daily Harvest Settlement Differ?

Daily Harvest and Stone Gate Foods previously agreed to a separate $22.999 million settlement. The court granted final approval to that settlement in October 2024. The Smirk's–Molinos agreement added a second source of recovery against different settling defendants. Some claimants could have rights under both agreements, but the administrators were required to account for applicable rules and avoid duplicative recovery for the same element of loss.

That domain now appears to have been repurposed and displays unrelated shopping pages. Do not enter personal or medical information there.
