What Happened at Systems East?
Systems East provides electronic payment and online billing services, including the Xpress-pay platform. The litigation followed an August 25, 2023 data-security incident involving a database with names and limited payment-card information associated with people who used Systems East services to pay other vendors or providers. More than 200,000 people were reported affected. Plaintiffs alleged that inadequate security measures allowed unauthorized access. Systems East denied wrongdoing, and the proposed settlement resolved the disputed claims without a liability finding.Who Was Included?
The settlement class generally covered people to whom Systems East sent notice of the incident on or around November 16, 2023. Receiving notice tied the person to the affected data population; using an unrelated payment platform or learning about the incident online did not by itself establish membership. Exclusions included specified company insiders, judges, people who validly opted out, and anyone found criminally responsible for the incident.What Benefits Were Offered?
A class member could choose an estimated $75 cash payment or request reimbursement of up to $8,000 for documented, unreimbursed losses fairly traceable to the incident. The cash amount could rise or fall depending on approved claims and available money. The loss category could include qualifying identity-theft or fraud losses, costs of obtaining or freezing credit reports, credit-monitoring expenses, and other reasonable mitigation costs. Systems East also agreed to implement and maintain specified information-security measures.What Proof Was Required?
The claim form used the unique notice ID and confirmation code to verify class membership. A person who requested the loss-reimbursement option also needed records supporting the amount and relationship to the incident, such as statements, receipts, credit records, or fraud correspondence. Unrelated transactions and most account digits could be redacted. The $75 alternative did not require proof of an $8,000 loss, but it still required a timely, valid claim from a class member.Why the Two Payment Options Were Alternatives
The agreement described the approximately $75 cash payment and up-to-$8,000 documented-loss reimbursement as alternative benefits. A claimant could not receive both for the same class membership. Loss payments were also subject to proportional reduction if approved amounts exceeded the available funding. The maximum was not a promise that every affected person had suffered $8,000 in damage.What the Public Documents Confirm
The federal court granted preliminary approval on August 15, 2024 and set the claim process and December hearing. Plaintiffs later filed a motion seeking final approval along with a proposed order. A proposed order shows what the parties asked the judge to enter; it is not itself proof that the judge signed it.
