What Changed Recently?

A settlement has been reached in a class action filed in July 2026 in Miami-Dade County Circuit Court alleging that Coast Dental Services, LLC, a dental practice operator based in Tampa, kept sending "recall" texts and placing calls encouraging people to book appointments after they had replied STOP. The complaint alleges violations of the federal Telephone Consumer Protection Act (TCPA) and the Florida Telephone Solicitation Act (FTSA). It also says the plaintiff had earlier brought the same claims in federal court in Florida.

Coast Dental denies each allegation of wrongdoing, liability and damages, and the notice says the court has not decided who is right. Under the settlement, notice goes to class members by email, with postcards for those without an email address.

Who Qualifies?

The settlement class covers all persons in the United States who, within the four years before the case was filed, received more than one text message or telephone call within any 12-month period reminding or encouraging them to schedule an appointment with Coast Dental, on their cell phone, after asking Coast Dental to stop by replying STOP or a similar opt-out instruction to its texts.

The settlement agreement says Coast Dental's records identify about 24,308 class members. The judge, Coast Dental and its affiliates, officers and employees, the released parties, their immediate families, class counsel and anyone who opts out are excluded.

How Much Can You Get?

Each claimant picks one benefit:
Both amounts are maximums. The notice says each payment is a pro rata share of what is available from the settlement fund after attorneys' fees and expenses, notice and administration costs, and any service award. Coast Dental agreed to make up to $3,840,664 available: up to $1,434,172 for cash claims and up to $2,406,492 for voucher claims. Under the settlement agreement, money that is not claimed and money from uncashed checks stays with Coast Dental. Class counsel will ask for $430,000 in fees and costs, about 11.2% of the fund, and a service award of up to $7,500 for the class representative. Coast Dental also agreed to adopt policies to comply with the TCPA and FTSA.

What Proof or Notice ID Is Required?

The online claim form opens with a login that asks for the Claim Number and PIN from the email or postcard notice. A claim form can also be downloaded from the settlement website and mailed. Under the settlement agreement, the claim form asks for the claimant's name, address, phone number, email address and the phone number that received Coast Dental's texts or calls. No receipts are needed; the claimant attests that they received more than one text or call after asking Coast Dental to stop. Only one claim is allowed per class member.

What Is the Deadline?

Claims must be submitted through the settlement website or mailed with a postmark by December 24, 2026. Requests to opt out must be mailed, personally signed and postmarked by October 30, 2026. Objections must be filed with the court and mailed to the clerk, class counsel and Coast Dental's counsel with a postmark by October 30, 2026.

How Do You Take Action?

What Happens Next?

Judge Javier A. Enriquez of the Eleventh Judicial Circuit in Miami-Dade County will consider final approval, the fee request and the service award at a hearing on December 9, 2026 at 10:30 a.m. in the court's Zoom virtual courtroom. The notice says the hearing may move without further notice. If the settlement is approved, the notice says payments are sent within 60 days after the settlement's Effective Date, and checks are valid for 90 days.

Questions

Who qualifies for the Coast Dental text message settlement?

People in the United States who, after replying STOP or a similar opt-out to a Coast Dental text, still received more than one text or call within a 12-month period reminding or encouraging them to schedule an appointment, on a cell phone, within the four years before the case was filed.

Is the Coast Dental payment cash or a voucher?

Each claimant chooses one: up to $59 in cash or up to a $99 voucher that can be used to buy an electric toothbrush sold by Coast Dental. A claimant who does not pick an option, or whose choice is unclear, receives the voucher.

Are the $59 and $99 amounts guaranteed?

No. They are maximums. The notice says each payment is a pro rata share of what is available after attorneys' fees and expenses, notice and administration costs, and any service award, so the final amount can be lower.

What happens to money nobody claims?

Under the settlement agreement, any part of the up to $3,840,664 that is not claimed, along with money from uncashed checks, stays with Coast Dental.

When will Coast Dental settlement payments be sent?

Only after final approval. The notice says payments go out within 60 days after the settlement's Effective Date, by check for the cash option, and checks are valid for 90 days.
