Current Status

Late claims are open through November 3, 2026. The original deadline was July 1, 2025, and the first round of payments went out after July 31, 2025; the settlement makes two payments in all, ending by March 8, 2027. Only the 91 workers identified in the Illinois Attorney General’s investigation are eligible, and each was mailed a notice and claim form with a Claimant ID and an individual payment amount. What Is This Settlement?

The Illinois Attorney General sued Polo Masonry Builders, Inc., United Builders Group Co., P2 Construction, Inc., A.L.L. Builders Group Co., A L L Contractor Services, Inc. and two company executives in the Circuit Court of Cook County, Chancery Division (Case No. 2024CH10221). The complaint alleged the companies misclassified workers as independent contractors in violation of the Illinois Employee Classification Act and paid overtime hours at straight time instead of the time-and-a-half the Illinois Minimum Wage Law requires.

The Attorney General’s office opened its investigation after complaints from the Bricklayers District Council 1 and the Illinois Department of Insurance. The companies, masonry contractors that worked largely in northern Illinois and were based in Glenview and Park Ridge, settled through a consent decree filed November 18, 2024, without admitting liability. Besides the payments, the decree requires the owners to tell the Attorney General’s office about any construction firms they run so those firms can be monitored for three years.

Who Qualifies?

The settlement covers the 91 workers listed in the consent decree, all identified by the Attorney General’s investigation of work performed for the companies between January 1, 2017 and January 5, 2023. It is not open to the general public or to other construction workers, and there is no way to join it without being on that list.

The notice states plainly, in English and Spanish, that a worker’s immigration status does not affect the right to receive payment. Notices were also issued in Ukrainian.

How Much Can Workers Get?

The total settlement is $555,000. The Attorney General’s office announced it as a $550,000 settlement; the consent decree sets the Settlement Amount at $555,000, of which $12,500 reimburses the office’s investigation costs and about $14,383 was estimated for administration. Each worker has an assigned share, listed in the decree, that the Attorney General’s office calculated from its investigation, and each payment equals that share of the settlement account after administration costs. The dollar amount for each worker is printed on that worker’s notice.

The companies pay the settlement in installments over about two years, so workers are paid in two rounds. Under the decree, the payments are treated as wages reported on Form W-2, with taxes withheld. Payment can be made by direct deposit or wire, by a prepaid paycard, or by check; electronic options are available only when filing online.

What Proof or Notice ID Is Required?

The claim form requires the Claimant ID printed on the mailed notice, along with the worker’s name, address, telephone number, email and a Social Security number or ITIN. No pay stubs or other records are required, because the Attorney General’s office already calculated each worker’s amount. By signing, the worker agrees to give up the right to sue the companies over the same claims for the same period.

What Is the Deadline?

Late claim forms are accepted until November 3, 2026. The settlement website and notice give a date only, with no time of day or postmark rule, so filing online before that date is the surest route. Workers who filed by July 1, 2025 do not need to file again.

How Do Workers File?

Workers can log in and file on the official settlement website using the Claimant ID from their notice, or sign the paper claim form that came with the notice and mail it back in the prepaid envelope. The website also has the notice and claim form in Spanish and Ukrainian. A worker who lost the notice can reach the settlement administrator, Atticus Administration, through the contact page on the official website.

What Happens Next?

The second and final payment is due by March 8, 2027. For any listed worker who has not filed a claim form by November 3, 2026, the consent decree directs the administrator to send that worker’s full payment to the Illinois Attorney General’s office as a check made payable to the worker or the Illinois Department of Labor.
