What Changed Recently?

Judge Cindi Port of King County Superior Court preliminarily approved the settlement in Milito v. STV Incorporated, et al., No. 25-2-39405-1 SEA, on August 10, 2026, and notices with each class member's estimated payment have gone out. The lawsuit, filed December 30, 2025, alleged that STV Incorporated and STV Construction, Inc. posted Washington job openings without the wage scale or salary range required by the state's Equal Pay and Opportunities Act, RCW 49.58.110. STV denies the claims and says it did not violate any law. The court has not decided who is right.

Who Qualifies?

The settlement class covers people who, from January 1, 2023 through July 26, 2025, applied through a posting on STV's website or an authorized third-party recruiting channel that did not disclose a wage scale or salary range, and who either:

STV says the class has 166 members, identified from its records. Class members who received a notice by email or mail were identified that way. Anyone who opts out is excluded.

How Much Can You Get?

The settlement website estimates each payment at $1,592.71. Every class member who files a valid claim receives an equal share of the net settlement fund, up to a maximum of $5,000 per person.

STV's total payment depends on how many people claim. It pays a minimum of $281,211.87 if 83 or fewer class members file valid claims, and the net fund grows by $1,611.89 for each additional valid claim, up to a maximum of $415,000. Before shares are calculated, the fund pays court-approved attorneys' fees of up to $122,425, costs of up to $2,500, a service award of up to $10,000 for the plaintiff and administration costs of up to $12,500; any unused administration money goes to claimants. If fewer than 83 people claim, the money left over goes to the Legal Foundation of Washington. The $1,592.71 figure is an estimate, and actual payments may differ.

What Proof or Notice ID Is Required?

Filing online requires the Login ID and PIN printed on the notice sent by the settlement administrator, Simpluris. The claim form asks for a signature, address, phone number and email under penalty of perjury. No pay stubs or job application records are required, but claims go through a verification process and the administrator may ask for more information.

What Is the Deadline?

Claim forms must be submitted online or by email, or postmarked if mailed, by December 8, 2026. The settlement agreement says claims filed after the deadline are considered only at STV's discretion. December 8, 2026 is also the deadline to opt out, by a signed letter sent by mail, and to object, by filing a written objection with the court and mailing copies to class counsel and STV's counsel.

How Do You Take Action?

Claims can be filed on the official STV settlement website using the Login ID and PIN from the notice. The site also explains how to return the paper claim form by mail or email. Class members who do nothing get no payment but are still bound by the release; those who want to keep the right to sue STV separately over these job postings must opt out instead.

What Happens Next?

The court will hold the final approval hearing on February 12, 2027 at 9:00 a.m. in King County Superior Court, with a remote option. (One section of the mailed notice lists an earlier hearing time; the settlement website and the notice's hearing section both give February 12, 2027.) If the court approves the settlement and no appeal is filed, STV funds the settlement within 30 days after it becomes final and the administrator mails checks within 14 days after that. Checks expire 180 days after they are issued, and uncashed money is turned over to Washington's unclaimed property program in the class member's name.

Questions

Why is the STV payment so much larger than other Washington job posting settlements?

The class is small. STV says 166 people are in the settlement class, so even the minimum fund is shared among relatively few claimants. The $1,592.71 figure is the settlement website's estimate. Each person's actual payment depends on how many class members file valid claims and on the fees and costs the court approves, and it is capped at $5,000.

What happens if more people file claims?

The total grows. If 83 or fewer people file valid claims, STV pays the minimum fund of $281,211.87. For each valid claim above 83, the net fund rises by $1,611.89, up to a total of $415,000. Because the fund grows with the number of claimants, the per-person amount stays roughly level instead of shrinking as more people file.

I applied to STV but did not get a notice. Can I still claim?

The settlement agreement says people who believe they were wrongly left off the class list must raise it with the settlement administrator or class counsel within 60 days of the notice mailing, and STV's records control unless the person can show documentary evidence that they belong in the class. The online claim form requires the Login ID and PIN from the notice; the settlement website says people who cannot find theirs can request them from the administrator.

Will filing a claim affect a job application with STV?

The court-approved notice says STV supports the settlement, will not retaliate against anyone for taking part, and that the decision to participate, not participate or object will not affect any application for employment with STV or its treatment of current or former employees.

What if fewer people file claims than expected?

If fewer than 83 people file valid claims, the money left over from the minimum fund after payments, fees and costs goes to the Legal Foundation of Washington, not back to STV. The settlement agreement also lets STV withdraw if more than 10 percent of the class opts out or fewer than 7.5 percent file claims.
