What Changed Recently?

Judge David E. Schwartz of the Circuit Court of DuPage County, Illinois preliminarily approved the settlement in Arman v. Al Piemonte Nissan, No. 2026LA000850, on September 16, 2026, and ordered notice to be sent to class members by October 31, 2026. The lawsuit alleged that the dealership sent marketing texts and made calls to people whose numbers were on the National Do Not Call Registry, in violation of the Telephone Consumer Protection Act. Al Piemonte Nissan denies wrongdoing, including on the grounds that it had an established business relationship with, or written consent from, the people it contacted. The court has not decided who is right.

The case began in federal court in Chicago in 2025, where it was dismissed without prejudice before any class was certified, and was then refiled in DuPage County. The parties settled after two mediation sessions with a retired judge.

Who Qualifies?

The settlement class includes people in the United States who, from May 9, 2021 through the date of preliminary approval:

The court's order says the dealership identified about 37,000 people who may be class members. People who received a notice by email or postcard were identified from the dealership's records. Excluded are the judges involved, the dealership and its affiliates, officers and employees, the released parties and their immediate families, class counsel and their families, and anyone who opts out.

How Much Can You Get?

Each class member who files a valid claim chooses one of two benefits:

Al Piemonte Nissan agreed to make up to $3.7 million in vouchers or up to $740,000 in cash available. That fund also pays attorneys' fees of up to $225,000, notice and administration costs of up to $30,000, and a service award of up to $5,000 for the plaintiff, if the court approves them. If the remaining money is not enough to pay every valid claim in full, payments are reduced pro rata. Unlike many settlements, any money left over after claims are paid goes back to the dealership, as do uncashed checks, which expire after 90 days.

What Proof or Notice ID Is Required?

Filing online requires the Login ID and PIN printed on the notice sent by the settlement administrator. The claim form asks for a name, address, the residential phone number that received the texts or calls, and a sworn statement that the claimant received more than one marketing text or call from the dealership within a 12-month period while the number was on the Do Not Call Registry, without a business relationship or written consent. No receipts are needed, but the administrator verifies each claim against the dealership's records, and the dealership can dispute claims it believes do not qualify.

What Is the Deadline?

The claim deadline is December 15, 2026. Claims filed online must be submitted by 11:59 p.m. Eastern Time on December 15, 2026. Paper claim forms must be signed and mailed with a postmark no later than December 15, 2026. The same date is the deadline to opt out, which must be done by a signed letter sent by mail, and to object, which requires filing a written objection with the court and sending a copy to the administrator.

How Do You Take Action?

Claims can be filed on the official Al Piemonte Nissan TCPA settlement website using the Login ID and PIN from the notice. The site also has a downloadable paper claim form, the long-form notice and the settlement agreement. Filing a claim releases TCPA and similar claims against the dealership over texts and calls during the class period; class members who want to keep the right to sue separately must opt out instead, and cannot also receive a payment.

What Happens Next?

Class counsel must file the motion for final approval and the request for attorneys' fees by December 17, 2026. The court will hold the final approval hearing by video conference on January 6, 2027. If the settlement is approved and no appeal is pending, vouchers and checks are to be mailed within 45 days after the settlement becomes final. The settlement agreement also lets Al Piemonte Nissan withdraw from the deal if more than 50 class members opt out.

Questions

Should I pick the $100 voucher or the $20 cash payment?

That is each class member's choice, and OCA does not recommend one over the other. Under the settlement agreement, the voucher does not expire and can be used for any products or services from Al Piemonte Nissan, while the cash payment is sent as a check that is valid for 90 days. Both amounts can be reduced pro rata if claims plus fees and costs exceed the settlement fund.

I received texts from Al Piemonte Nissan but never got a notice. Can I still file?

The online claim form requires the Login ID and PIN printed on the notice. The settlement website says people who cannot find theirs can request them from the settlement administrator by providing their full name and mailing address. A paper claim form is also available on the settlement website. The administrator checks each claim against the dealership's records.

Does it matter how many texts or calls I received?

No. Each class member gets one payment, regardless of how many texts or calls were received, as long as the person received more than one within a 12-month period while the number had been on the Do Not Call Registry for at least 30 days.

Can Al Piemonte Nissan challenge my claim?

Yes. The settlement agreement lets the dealership dispute a claim the administrator has approved if its records show no qualifying texts or calls, a business relationship or written consent, or that the number was a business line. A claimant can respond with documentation and a sworn statement within 30 days.

When will payments be sent?

Not before the court grants final approval, which it will consider at the January 6, 2027 hearing, and any appeals are resolved. Under the agreement, the administrator mails vouchers and checks within 45 days after the settlement becomes final. No payment date had been announced as of October 27, 2026.
