What Is This Settlement About?

A settlement has been reached with Wyssta Services, Inc. (Wyssta) in a class action lawsuit over tracking technology on a Delta Dental member website. The case is Michael Feeler v. Wyssta Services, Inc., Case No. 2026LA000050, in the Circuit Court of Sangamon County, Illinois.

The lawsuit alleges that Wyssta violated the federal Electronic Communications Privacy Act and the Illinois Eavesdropping Statute when it allegedly installed advertising and analytics tracking technologies, such as cookies and pixels, on a website it operates for Delta Dental plan members, my.deltadentalcoversme.com, without users' knowledge or consent. Wyssta denies the allegations and any liability or wrongdoing, and no court has decided that the company did anything wrong. Who Qualifies?

The Settlement Class is every natural person in the United States who, between January 23, 2021, and January 23, 2025, held an account on the online healthcare portal at my.deltadentalcoversme.com. If you logged into an account on that website during that period, you are a Settlement Class Member.

Excluded from the class are Wyssta and its officers and directors, anyone who timely and validly opts out, the judges assigned to the case and their staff and immediate family, and Class Counsel. You will need the Class Member ID from your email or postcard notice to file, so keep that notice handy.

How Much Can You Get?

The Defendant has agreed to fund the settlement with up to approximately $12,670,284. Out of that fund, each Settlement Class Member who submits a valid and timely Claim Form is entitled to a cash payment of up to $16.50.

If the total of valid claims is more than the money left in the fund after notice and administration costs, attorneys' fees, costs, and the service award are paid, each payment will be reduced pro rata — meaning proportionally — so the per-person amount could be lower than $16.50. The fund also does not pay out in full if relatively few claims are filed; you must file to receive anything.

Is Proof Required?

Yes. To file, you must enter the Class Member ID printed on the email or postcard notice the Settlement Administrator sent you. No receipts or out-of-pocket documentation are required, but because filing is gated on that administrator-issued code, the page is marked proof required — a claimant who never received the notice, or who discarded it, cannot file without first obtaining the ID.

How to File a Claim

The only way to receive a payment is to submit a valid Claim Form by August 20, 2026. You can file online through the official settlement website, WysstaServicesClassAction.com, using the Submit Claim option, or print a Claim Form from the Important Documents section of that website and mail it to the Settlement Administrator postmarked by August 20, 2026.

Filing online also lets you elect to receive your payment electronically (for example, by Zelle, Venmo, PayPal, or ACH). If you file by mail, you will receive a check at the address you provide.

Attorneys' Fees and Service Award

Class Counsel — Eric S. Dwoskin and Nicholas F. Wasdin of Dwoskin Wasdin LLP — will ask the Court to approve attorneys' fees and costs not to exceed $2,500,000 (about 19.74% of the settlement benefit cap), plus a service award of $3,000 for the named representative plaintiff who brought the case. These amounts come out of the settlement fund and are subject to Court approval.
