How the Payments Were Sent

The payment method followed the way each claim was filed. According to the settlement website, claims submitted on a paper form were paid by paper check. Claims submitted online were paid by the method the claimant picked on the online form, with options that included Zelle, PayPal, Venmo, a virtual prepaid Mastercard and direct deposit. Notices for electronic payments were sent by email from the payment providers, and the website notes that some may have been filtered into spam or junk folders.

The site does not publish the size of each pro rata payment. Under the settlement, the net fund is split evenly among every valid claim for the pro rata cash benefit, so the amount depends on how many such claims were approved. In the final approval order, the court noted that Kroll reported a claims rate of 0.50% once the claim deadline had passed.

What the Settlement Provided

PharMerica agreed to pay $5,275,000 into a non-reversionary settlement fund. After administration costs, PharMerica's data-mining costs to confirm class membership, service awards and the portion of attorneys' fees assigned to the fund were paid, the remainder was set aside for equal pro rata cash payments to class members who submitted valid claims for that benefit.

Two benefits sat outside the fund. PharMerica agreed to reimburse documented out-of-pocket losses tied to the data incident, up to $10,000 per class member, and to provide one year of Kroll Complete Monitoring to every class member, whether or not they filed a claim. The monitoring includes credit and dark web monitoring, identity theft restoration services and $1,000,000 in identity theft insurance, and its one-year term begins when a class member uses an activation code. The agreement also describes information-security changes PharMerica says it has adopted.

The court awarded class counsel $3,481,750 in attorneys' fees, of which $1,740,750 comes from the settlement fund and $1,741,000 is paid directly by PharMerica, plus $88,328.16 in litigation costs. Each class representative received a $3,500 service award.

Who Was in the Class

The settlement class is all living persons in the United States who were provided notice of the PharMerica data incident. Directors and officers of PharMerica, government entities, people who opted out, the assigned judges, their immediate families and court staff are excluded. The final approval order says about 1.45 million class members received direct notice, roughly 73.72% of the class. Four people opted out on time, one opted out late, and no objections were filed by the April 13, 2026 deadline.

What the Case Was About

PharMerica provides pharmacy services to health care facilities and programs across the country. The plaintiffs allege that in March 2023 a ransomware group targeted PharMerica's network and took 4.7 terabytes of data, including personal and health information. Individual lawsuits filed in the Western District of Kentucky were consolidated on July 19, 2023. In June 2024 the court granted in part and denied in part PharMerica's motion to dismiss, and the parties reached a settlement at a mediation on August 1, 2025.

PharMerica denies any wrongdoing, and the court's final order states that the settlement is not an admission of liability. The allegations were never decided at trial.

What Happens Next

April 10, 2027 is the last date listed for the current checks. The final judgment keeps the court's jurisdiction over the administration of the settlement and any distribution of the fund. The settlement website does not say what will happen to money from checks that are never cashed.
