A federal judge has granted preliminary approval to a proposed class action settlement in In re Motility Data Breach Litigation, Case No. 3:25-cv-00330, pending in the U.S. District Court for the Southern District of Ohio, Western Division at Dayton.
The settlement concerns claims related to a data incident allegedly affecting Motility Software Solutions, Inc., a dealer management software company. The preliminary approval order states that the settlement class consists of 760,797 settlement class members.

The original complaint alleges this case arose from Motility’s alleged failure to protect highly sensitive data of about 760,000 people.
According to the complaint, Motility discovered suspicious activity on August 19, 2025, took the impacted server offline, began an investigation with cybersecurity experts, and notified law enforcement. The complaint alleges Motility’s parent company, The Reynolds and Reynolds Company, disclosed the incident around September 12, 2025.
The complaint alleges cybercriminals accessed personally identifiable information, including at least names, birthdates, driver’s license numbers, and Social Security numbers. The complaint also alleges consumers may have provided information through dealer records, including contact information, financial information, and insurance information.
The preliminary approval order conditionally certifies the following settlement class for settlement purposes:
All individuals residing in the United States who were impacted by the Data Incident.
The order excludes Motility officers and directors, governmental entities, the judge assigned to the action, the judge’s immediate family, court staff, and any settlement class member who timely and properly opts out of the settlement.

The complaint alleged Motility failed to maintain reasonable cybersecurity safeguards and failed to adequately protect personal information. It also alleged cybercriminals accessed sensitive data and that impacted individuals face increased risk of identity theft and fraud.
The complaint asserted claims including negligence, negligence per se, breach of implied contract, unjust enrichment, and declaratory judgment. The settlement resolves claims for settlement purposes only and does not mean Motility admitted wrongdoing.
The court still must decide whether to grant final approval. At final approval, the court will review whether the settlement is fair, reasonable, and adequate, whether the notice program and claims process should be approved, and whether requested attorneys’ fees, expenses, and service awards should be awarded.
The preliminary approval order states class counsel may request attorneys’ fees of up to one-third of the settlement fund plus litigation expenses, subject to court review.
