What's the Forever 21 Class Action Settlement About?

This class action is closed to new claims. From April 13, 2017 to October 24, 2017, certain Forever 21 stores were the target of a cyber-attack in which criminals accessed Forever 21's computer systems. They publicly announced the Security Incident on December 28, 2017. The Security Incident potentially resulted in unauthorized access to customer payment card data, including payment card number, expiration date, and name.

How Much Can I Get From the Forever 21 Lawsuit?

There were two types of payments that are available:

• Expense Reimbursement: This includes time spent (up to 4 hours & $25), reimbursement of self-paid credit monitoring, and expense reimbursement of up to $250 and

• Extraordinary Expense Reimbursement: For Class Members who had other extraordinary non-reimbursed monetary losses because of information compromised as part of the Security Incident are eligible to make a claim for reimbursement of up to $10,000 and

You may submit a claim for either or both types of payments. You must provide proof of your class membership by submitting the number associated with the credit or debit card used at a Forever 21 store.

How Do I Qualify?

The Settlement Class includes anyone in the United States who used a credit, debit, or other payment card to make a point-of-sale purchase at an affected Forever 21 store while payment card data at the store was at risk or whose payment card data was inadvertently stored in a Forever 21 central database.

How Do I File a Claim?

To ask for a payment you can fill out the Claim Form online or you can mail it postmarked no later than March 21, 2022. The Court held a Fairness Hearing at 8:30 a.m. on April 21, 2022, at the United States District Court for the Central District of California.
