What's This Settlement About?

UKG, Inc. has agreed to a class action settlement in the amount of $3,362,026.50. They allegedly violated BIPA by collecting individuals' biometrics through finger scans or facial scanning technology in Illinois without first providing the required disclosures or obtaining the consent required by BIPA.

BIPA, or the Illinois Biometric Information Privacy Act prohibits private companies from capturing, obtaining, storing, transferring, and/or using the biometric identifiers and/or information, such as finger scans, of another individual for any purpose without first providing them with certain written disclosures and obtaining written consent.

UKG, Inc. is a Human Resources and workforce management software company that created technology that allows companies to keep track of and manage their employees. Their products or technologies included the UltiPro TimeBase timeclock and the UltiPro TouchBase timeclock, which allegedly scanned fingerprints while breaking the BIPA Illinois law. The data breach at the center of this class action is simliar to other nationwide class actions that affect millions of Americans, such as the Experian data breach and the Herff Jones data breach , which you may also qualify for you.

How Do I Qualify?

You are a legitimate member of this class action if you scanned your finger or had your photograph taken in Illinois between March 3, 2015, and December 29, 2021, while using an UltiPro TimeBase timeclock or UltiPro TouchBase timeclock, or scanned your finger using a NOVAtime timeclock (Model Nos. 450 or 7000) provided by UKG, Inc.

What Can I Get?

The amount of payments each claimant can receive will be approximatley $200 to $400, and will depend on the the total amount of valid claims made and the attorney fees, which typically amount to about 30% of the total settlement amount.

How Do I File a Claim?

If you are a member of the Settlement Class, then you may submit a claim online (see below).

You'll have to provide your unique ID which if don't recive one from the settlement Notice you are able to get by contacting the Settlement Administrator through the official settlement website, UKGBIPASettlement.com.

The Court will hold the Final Approval Hearing on May 20, 2022, at 8:45 a.m.
