What Is the Banner Health Privacy Settlement About?
Banner Health has agreed to settle a class action lawsuit alleging that it disclosed patients'
personally identifiable information (PII) and protected health information (PHI) to third parties —
including Meta Platforms, Inc. (Facebook) and Google LLC — through tracking technologies installed on
Banner's website and webpages. The Plaintiffs allege that Banner's use of these tracking tools invaded
Settlement Class Members' privacy and gave rise to other alleged common law and statutory violations.
Banner denies all allegations of liability and wrongdoing, and the Court has not decided who is right.
The lawsuit is captioned McCulley, et al. v. Banner Health, Case No. 2026CV30182, and is pending
in the District Court for Weld County, Colorado. Under the settlement, every Settlement Class Member who
does not opt out will automatically receive a code for one year of CyEx Privacy Shield Pro, and eligible

Who Qualifies for the Banner Health Settlement?
You are a Settlement Class Member if you had a Banner Health Patient Account (formerly the MyBanner
patient portal) and logged into that account using one of Banner's web properties or applications on or
between June 1, 2020 and November 22, 2023. The Settlement Class is made up entirely of individual
people and is estimated at approximately 1,028,000 members.
Excluded from the class are Banner and any entity it controls, along with its affiliates, parents,
subsidiaries, officers, directors, legal representatives, successors, and assigns; any judge or judicial
officer presiding over the case, together with their immediate family and judicial staff; and anyone who
timely and validly excludes themselves from the Settlement. Banner's records identify Class Members, and
the Settlement Administrator sent notices with a Class Member ID to people on that list. If you received
a notice, you are on the eligibility list.
What Are the Settlement Benefits?
The settlement provides two benefits:
One year of CyEx Privacy Shield Pro (automatic): Every Settlement Class Member who does not opt out will automatically receive a code to enroll, at no cost, in one year of CyEx Privacy Shield Pro. You do not have to file a claim to get this benefit.
$20 cash payment (claim required): To receive the cash payment, you must submit a valid Claim Form by the deadline. Online filers can choose Venmo, PayPal, or Zelle; claims submitted by mail are paid by check.
Under the settlement, Banner will pay for all valid and Approved Claims, the costs of notice and
administration, Court-approved attorneys' fees and expenses, and Service Awards for the Class
Representatives. Class Counsel may request attorneys' fees, costs, and expenses of up to $3,750,000, and
the Class Representatives may request Service Awards of up to $2,500 each — all subject to Court approval
and paid by Banner.
About the CyEx Privacy Shield Pro Benefit
The one-year CyEx Privacy Shield Pro membership includes Dark Web Monitoring, VPN In Touch, Password
Scan, Private Search functionality, Password Defense, Digital Vault, and Data Broker Opt-Out services.
After the Court grants final approval, the Settlement Administrator will send enrollment instructions and
the activation code to all Settlement Class Members who did not opt out. Enrollment does not require a
credit card or any other payment method, and the membership will not automatically renew at the end of
the one-year term.
How to File a Banner Health Claim
There are two ways to file, both with the same September 5, 2026 deadline:
Online: Go to the official settlement website and log in with your Class Member ID (it begins with 83411). Confirm your contact information and choose Venmo, PayPal, or Zelle for payment. Online claims must be submitted by September 5, 2026.
By mail: Complete the paper Claim Form, sign the attestation, and mail it to the Settlement Administrator. Mailed claims must be postmarked by September 5, 2026, and are paid by check.

If the Court grants final approval and no appeals are filed, settlement benefits will be distributed
after the settlement becomes final. Appeals, if any, can delay payment. If you do nothing, you will not
receive the $20 cash payment and, unless you opt out, you will give up the right to sue Banner over the
claims this settlement resolves — but you will still be able to enroll in the CyEx Privacy Shield Pro
benefit.
Tracking Pixels and Health Privacy Lawsuits
