If you were a patient at Affiliated Dermatologists & Dermatologic Surgeons, P.A. and your personal information was compromised in a data breach discovered in March 2024, you may be entitled to up to $5,000 in cash — or a guaranteed $40 payment with no proof required.
The breach exposed some of the most sensitive data imaginable: Social Security numbers, medical treatment records, health insurance claims, driver's license numbers, passport numbers, and other protected health information.
A class action settlement has been reached. On top of cash payments, every class member automatically receives 3 years of free credit monitoring — no claim form needed for that benefit.
On or about March 5, 2024, Affiliated Dermatologists & Dermatologic Surgeons discovered a data breach that resulted in potential unauthorized access to patients' private information.
The information exposed in the breach includes:
• Social Security numbers
• Dates of birth
• Medical treatment information
• Health insurance claims information
• Driver's license numbers
• Passport numbers
• Other non-public personally identifiable information
• Protected health information (PHI)
This is an especially dangerous type of breach because it combines financial identity data (SSN, driver's license) with medical records — giving bad actors everything they need for both financial identity theft and medical identity theft.
Why Medical Data Breaches Are Especially Dangerous
When your dermatologist's office gets hacked, it's not just your name and email at risk. Medical data breaches expose information that can be used to:
• Open fraudulent credit accounts in your name using your SSN
• File fake health insurance claims using your insurance information
• Obtain prescription drugs under your identity
• Create false medical records that could affect your future treatment — for example, wrong blood type, wrong allergies, or wrong medications in your file could be life-threatening in an emergency
• Commit tax fraud using your SSN and date of birth
• Apply for government benefits in your name
Unlike a stolen credit card number (which can be cancelled and replaced), your Social Security number, medical records, and passport number cannot be changed. Once this data is in the wrong hands, the risk lasts for years.
Who Qualifies for the Settlement?
You are a class member if you are a living individual in the United States whose private information was implicated in the data breach discovered on or about March 5, 2024.
If you received a breach notification letter, email, or postcard from Affiliated Dermatologists, you are almost certainly a class member.
Excluded from the class: directors and officers of Affiliated Dermatologists, governmental entities, and the assigned judge and court staff.
How Much Can I Get?
You have two payment options. Choose one:
Option A: Up to $5,000 for Documented Losses
If the data breach caused you financial harm, you can claim up to $5,000 by providing reasonable documentation of your losses. Covered expenses include:
• Bank fees related to the breach
• Phone charges (long distance or per-minute cell charges)
• Data charges (if billed by usage)
• Postage costs
• Gas for local travel related to dealing with the breach
• Credit reports or credit monitoring services you purchased
• Identity theft insurance products you purchased
Acceptable documentation: phone records, receipts, emails, and correspondence from third parties. Personal statements alone don't count as documentation but can be included as supporting context.
Important: You can't claim expenses that were already reimbursed by another source, including any credit monitoring provided by Affiliated Dermatologists in the original breach notification.
Option B: $40 Cash — No Documentation Needed
If you don't have documented losses (or just want the easiest option), you can claim a flat $40 payment with no documentation required. Just submit the claim form.
Note: If total valid claims exceed $1 million, all payments (both Option A and Option B) will be reduced proportionally. The $40 could go up or down depending on how many people file.

Every class member automatically receives 3 years of free credit monitoring — you do not need to submit a claim form for this benefit. Your enrollment code was included in the breach notification you received.
If you already have active credit monitoring, you can delay activation for up to 12 months so the coverage doesn't overlap.

For the $40 no-documentation payment, just fill out the claim form — that's it. For the up to $5,000 documented losses payment, include your supporting receipts, records, or correspondence.
What Happens If I Do Nothing?
If you do nothing:
• You will not receive a cash payment
• You will still automatically receive 3 years of free credit monitoring
• Your legal claims against Affiliated Dermatologists are released — meaning you give up the right to sue them over this breach
Since the $40 option requires zero documentation, there's no reason not to file a claim and collect the cash on top of the free credit monitoring.
