What is the Aura Frames Biometric Privacy Class Action About?
You may be owed $13.28 or more from a new open class action with Aura Frames, who have agreed to a class action settlement after being alleged to have violated a privacy law known as the Illinois
Biometric Information Privacy Act class action.
The class action lawsuit claims that Aura unlawfully possessed,
collected, captured, stored, used, or otherwise obtained Illinois users facial geometry data without first
providing the written disclosures and data policies that the Illinois Biometric Information Privacy Act
requires, and without obtaining written consent.
Aura Frames denies all allegations, denies that the facial matching data at issue can identify individual users,
and denies that this data qualifies as biometric identifiers or biometric information under BIPA. The Court
has not decided who is right. The parties agreed to this settlement to avoid the risks, costs, and delays of
continued litigation.
Who are Aura Frames?
Aura Frames is a smart photo frame company that sells digital picture frames and a companion app, also known
as Aura Home. Users can
upload photos from phones and cloud services to display on Wi Fi connected frames. The service uses software
to help organize and manage photos, which allegedly included facial matching features that are at the center
of this Illinois BIPA lawsuit for accounts created in Illinois.
Who Qualifies for a Payment?
You are included in the Settlement Class if all of the following are true:
• You signed up for an Aura account within the State of Illinois
• You did so between July 16, 2019 and November 4, 2025
• Aura collected facial matching data from your photographs for that account
• You created your Aura account in Illinois prior to December 7, 2023
To receive money from the settlement, you must submit a claim form and attest under penalty of perjury that
you meet the class definition above.
What Does the Settlement Provide?
If the Court grants final approval, the settlement will create a fund of up to $1,897,553. From this fund,
the following will be paid:
• Settlement payments to class members with valid and timely claims
• Settlement administration costs and notice costs
• Court approved attorneys fees, costs, and expenses
• Service awards to the class representatives, subject to Court approval
In addition to money, Aura has stopped collecting facial matching data from Aura users, including users in
Illinois, as of December 7, 2023. Under the settlement, Aura agrees to continue not collecting facial
matching data from Illinois Aura users unless it provides BIPA compliant notices and obtains BIPA compliant
consents, or BIPA is amended, repealed, invalidated, or found unconstitutional.
How Much Can I Get Paid?
Class members who submit valid claims are expected to receive up to about $13.28 by check. This amount is an
estimate and may change based on:
• The total number of valid claims filed
• The amount the Court approves for attorneys fees, costs, and class representative service awards
• The cost of administering and notifying the class
Payments will be made on a pro rata basis, which means each claimant receives a proportional share of the
net settlement fund.
How to File a Claim
To receive a payment, you must submit a claim form by the deadline. You can file online or by mail:
• Online: Visit the official settlement website at www.AFBIPAsettlement.com and complete the claim form.
• Mail: Download and print a paper claim form from the settlement website, complete it, and mail it
to the settlement administrator at the address listed on the form.
Claim forms must be submitted online by 11:59 p.m. Central Time on February 2, 2026, or postmarked by
February 2, 2026, if submitted by mail.

What Are My Award or Payout Options?
• Submit a claim form: Receive a payment if you qualify and your claim is approved. You give
up the right to sue Aura separately over the released claims.
• Do nothing: You stay in the Settlement Class and release claims but receive no payment.
• Exclude yourself by January 16, 2026: You remove yourself from the Settlement Class, keep
your right to sue Aura separately, and will not receive a payment from this settlement.
• Object by January 16, 2026: You remain in the class and tell the Court why you do not
agree with part of the settlement. You can also ask to speak at the final approval hearing.
How to Opt Out
To exclude yourself from the Aura Frames settlement, you must mail or deliver a written request for
exclusion stating that you want to be excluded from the Bulgatz v. Aura Home, Inc. d/b/a Aura
Frames settlement. Your request must include:
• Your name
• Your mailing address
• Your personal signature

• A statement that you wish to be excluded from the settlement

How Do I Object to the Aura Frames Open Class Action?
If you stay in the Settlement Class, you can object to the settlement. To object, you must file a
written objection with the Court and mail copies to Class Counsel and Aura counsel by January 16,
2026. Your objection must include:
• Your name and address
• An explanation of why you believe you are in the Settlement Class
• All reasons you object to the settlement, with any supporting documents
• Information about any attorneys who represent or assist you with your objection
• A statement about whether you plan to appear at the final approval hearing, and whether you
