What Changed Recently?

Tandem Diabetes Care, Inc., the San Diego insulin pump maker, agreed to pay up to $1,500,000 to resolve Ostrie v. Tandem Diabetes Care, Inc., Case No. 25CU057437C, in the Superior Court of California for San Diego County. The parties signed the settlement agreement on July 1, 2026, and the court granted preliminary approval on August 28, 2026.

The claims allege that Tandem did not pay California non-exempt employees for all hours worked, overtime, paid sick leave and meal and rest period premiums, paid wages late, and issued inaccurate wage statements, along with federal overtime claims. Two federal theories drive the out-of-state portion: that Tandem left vesting restricted stock units (RSUs) out of the regular rate used to calculate overtime, and that Customer Care employees were not paid for all hours worked. Tandem has not admitted the claims.

Who Qualifies?

The settlement has three overlapping groups:

• California Class: all non-exempt Tandem employees in California at any time from October 23, 2021 through March 29, 2026, about 157,951 workweeks in total. They are included automatically unless they opt out.
• Federal collective, outside California: non-exempt employees elsewhere in the U.S. who either had RSUs vest during the covered period while also earning overtime, or worked in a non-exempt Customer Care role listed in the agreement (titles include Customer Care Specialist, Appeals Specialist and Benefits Verification Specialist), about 70,105 Customer Care workweeks.
• State penalty group: California Class members who worked from September 11, 2024 through August 28, 2026. They receive a small additional payment from the state penalty portion even if they opt out of the class.

How Much Can You Get?

No per-person estimate has been published. The agreement sets the formula. From the $1.5 million, the court may award attorneys’ fees of up to one-third ($500,000) plus expenses, service awards of up to $7,500 each to four employees who brought or supported the claims, and the administrator’s costs. What remains is split:

• 60% resolves the California claims. Of that, $75,000 goes to state penalties ($48,750 to the California Labor and Workforce Development Agency and $26,250 to the penalty group, divided by pay periods). The rest is divided among California Class members by weeks worked.
• 40% resolves the out-of-state claims: 70% of it is divided among Customer Care employees by weeks worked, and 30% among RSU employees by number of RSU vesting events.

The total can rise if actual workweeks come in more than 5% above the estimates in the agreement.

What Proof or Notice ID Is Required?

None. Payments are calculated from Tandem’s payroll and equity records. California Class members do nothing to be paid. Out-of-state collective members opt in by signing the claim form on the back of their settlement check or by depositing or cashing it within 180 days of issue. Uncashed California checks go to the State Controller’s Unclaimed Property Fund in the employee’s name.

What Is the Deadline?

Requests to opt out and objections from California Class members must be postmarked within 45 days after CPT Group first mails the notice. Under the agreement, Tandem has 45 days after preliminary approval to deliver employee data, and CPT Group then has 14 days to mail, so on that schedule notices were due to be mailed by about October 26, 2026. The actual mailing date has not been published. Out-of-state collective members have 180 days from the date their check is issued to cash it.

How Do You Take Action?

There is no settlement website or online form. Employees are contacted by mail from the address Tandem has on file, so a current mailing address with Tandem or CPT Group matters. The mailed notice explains how to opt out, object or dispute the workweeks credited.

What Happens Next?

After the notice period, the court will hold a final approval hearing; its date has not been made public. Checks go out only after final approval and the end of any appeal period.

Questions

How do Tandem employees outside California join the settlement?

Eligible employees outside California receive a settlement check after final approval. Signing the claim form printed on the back of the check, or depositing or cashing it within 180 days, is what opts them into the federal overtime settlement. A check that is never cashed means no payment and no participation.

Which Tandem employees outside California are covered?

Two groups of non-exempt employees: those whose restricted stock units vested during the covered period while they also earned overtime, and those who worked in non-exempt Customer Care roles listed in the agreement, such as Customer Care Specialist, Appeals Specialist and Benefits Verification Specialist.

Why does the settlement mention restricted stock units?

One of the claims is that Tandem left the value of vesting restricted stock units out of the regular rate of pay used to calculate overtime. Tandem has not admitted the claim. Under the settlement, 30% of the out-of-state share is divided among employees with RSU vesting events during the covered period.

Is there a settlement website?

None is named in the settlement agreement or the state labor agency record. CPT Group, the administrator, mails notices directly to employees using Tandem’s records.
