What Is This Settlement About?

If you were a member of Boston Sports Club and you were charged in April 2020 while every single BSC location was shut down because of COVID, the Massachusetts Attorney General just won your money back.

Here is what happened. When COVID hit in March 2020, all Boston Sports Club locations closed and stayed closed through July 2020. Despite every gym being physically inaccessible, BSC's former CEO Patrick Walsh decided to bill members for April 2020 anyway. He knowingly charged people for gym services he knew BSC would not and could not provide.

Members were furious. Over 2,000 people filed complaints with the Attorney General's office. Members testified at trial that they called, emailed, and sent social media messages trying to cancel their memberships -- and got no response. Some members who did submit cancellation requests were charged anyway. The whole thing was a mess.

The Massachusetts Attorney General sued and won at trial. The court found that Walsh's decision to bill members during the closure was unfair, that he made deceptive statements to members, and that BSC violated the Massachusetts Health Club Act by blocking members from canceling their contracts. Now nearly $4 million in restitution is being distributed to approximately 47,000 consumers.

How Do I Claim My Refund?

The Attorney General's office has already identified who qualifies and is sending emails directly to eligible members. Here is what to do.

Check your email for a message from bostonsportsclubrefund@refundadministrator.com. This email contains your claim number and PIN. If you do not see it in your inbox, check your spam, junk, and promotions folders.

Go to BostonSportsClubRefund.com and log in with your claim number and PIN.

Select your preferred payment method. You will be given options for how to receive your refund.

You must claim your refund within 90 days of receiving the email, but no later than June 16, 2026.

What If I Did Not Get the Email?

If you believe you were a BSC member who was charged in April 2020 while the gyms were closed, but you did not receive the refund email, contact the Refund Administrator at bostonsportsclubrefund@refundadministrator.com.

If you do nothing at all, the Refund Administrator may still attempt to send your refund through Zelle or mail a paper check. But filing the claim form ensures you get your preferred payment method and receive your refund faster.

How Much Will I Get?

The total restitution pool is nearly $4 million for approximately 47,000 members. Your individual refund amount will be the full amount you were unfairly charged in April 2020 while the gyms were closed. The exact amount depends on your membership type and monthly billing rate at the time.

This is not a partial credit. The court ordered full refunds for members who were unfairly billed and had not already received credits or refunds from BSC.

Who Qualifies?

You qualify if you were a Massachusetts Boston Sports Club member who was billed in April 2020 while all BSC locations were closed due to COVID, and you did not already receive a credit or refund for that billing from BSC.

You do not need to sign up or apply. The Attorney General's office has already identified eligible members using BSC's billing records. If you qualify, you should have received (or will receive) an email with your claim number and PIN.

This Is Not a Class Action -- It Is Even Better

This is actually a state Attorney General enforcement action, not a traditional class action lawsuit filed by private attorneys. The difference matters: the Massachusetts AG sued on behalf of consumers, won at trial, and the court ordered full restitution. There is no need to prove individual damages. There is no pro rata reduction. There are no massive attorney fee deductions from the fund. You get back what you were charged.
