Concord Hospital pixel tracking class action settlement — $800,000 fund over website tracking technology that allegedly shared visitor information with third parties
Plaintiffs allege tracking technology on Concord Hospital's web properties intercepted visitors' communications and disclosed protected health information to third parties such as Google and Geonetric.

What Is the Concord Hospital Pixel Settlement About?

Concord Hospital, Inc., Concord Hospital – Laconia, Concord Hospital – Franklin, and Capital Region Healthcare Corporation (collectively, "Concord") have agreed to an $800,000 class action settlement to resolve claims over third-party tracking technology on their web properties. The case is captioned Branson & Phillips v. Concord Hospital Inc. et al., Case No. 217-2024-CV-00295, pending in the Hillsborough Superior Court in Manchester, New Hampshire.

The lawsuit alleges that Concord violated the New Hampshire Wiretapping and Electronic Surveillance Act and the New Hampshire Patient Privacy Law by using third-party tracking technology — including website pixels such as Google Analytics and Geonetric — on the Concord Web Properties. Plaintiffs allege the trackers may have intercepted visitors' telecommunications and disclosed their protected health information to third parties. Concord denies any wrongdoing or that it violated any laws. The settlement does not establish who is right or wrong; it is a compromise to end the lawsuit and avoid the uncertainty and expense of continued litigation.

Who Is Concord Hospital?

Concord Hospital is a health care system based in Concord, New Hampshire, with additional hospital campuses in Laconia and Franklin operated under Capital Region Healthcare Corporation. Like most health systems, Concord runs websites and web pages where patients can find providers, look up services, and manage care online. The settlement covers people who used those web properties — a roughly five-year window of website use. Concord, New Hampshire–area patients may also want to check the separate Concord Orthopaedics data breach settlement, which involves a different defendant and a different incident.

Who Qualifies for the Concord Hospital Settlement?

There are two settlement classes, both covering the period from May 9, 2021 through June 12, 2026:

• Individuals whose telecommunications were allegedly intercepted by Google and/or Geonetric while using the Concord Web Properties during the class period; and
• Individuals whose protected health information may have been disclosed to Google, Geonetric, or other online tracking technology while using the Concord Web Properties during the class period.

Excluded from the settlement classes are the defendants and their officers and directors, anyone who timely and validly requests exclusion (opts out), and the judges assigned to the case along with their staff and family.

How Much Can You Get?

Concord will pay $800,000 into a settlement fund. From that fund, the court may approve deductions for Class Counsel's attorneys' fees of up to 33.33% of the fund plus reasonable litigation expenses, service awards of up to $2,500 for each class representative, and the costs of settlement notice and administration.

Whatever remains after those deductions is distributed pro rata to settlement class members who submit valid, timely claim forms. Because payments are pro rata, there is no fixed dollar amount per person — the more valid claims filed, the smaller each individual share, and vice versa. The settlement administrator will calculate approved payments after the claim period closes and the settlement becomes final.

Do I Need Proof to File?

No. If you received a notice by mail or email, it includes a LoginID and PIN you can use to start your claim on the settlement website, but the website also allows you to file a claim without a LoginID and PIN. Whether you file online or by mail, you complete a certification stating that at least once between May 9, 2021 and June 12, 2026 you accessed or used a webpage or mobile application operated by or associated with Concord Hospital, Concord Hospital – Laconia, Concord Hospital – Franklin, or Capital Region Healthcare Corporation. No receipts or documentation are required, though the administrator may contact you to verify the information on your claim.

How Do I File a Concord Hospital Settlement Claim?

You must submit a valid claim form to receive a payment — class members who do nothing get no money and still release their claims. You can file online at ConcordPixelSettlement.com, or download a claim form from the settlement website to complete and mail to the settlement administrator. Either way, your claim must be submitted online or postmarked no later than September 11, 2026.

To file online:

• Visit ConcordPixelSettlement.com and open the claim form
• Log in with the LoginID and PIN from your notice, or use the option to file without them
• Certify that you used a Concord web property at least once between May 9, 2021 and June 12, 2026
• Choose how you want to be paid — Venmo, Zelle, PayPal, or a mailed check
• Submit online, or print and mail your claim form postmarked by September 11, 2026

Key Deadlines

• September 11, 2026: Deadline to submit a claim form (online or postmarked)
• September 11, 2026: Deadline to exclude yourself (opt out) of the settlement
• September 11, 2026: Deadline to object to the settlement
• November 3, 2026: Final Approval Hearing at 9:00 AM at the Hillsborough Superior Court, Manchester, NH

You are not required to attend the Final Approval Hearing. If the court approves the settlement, payments are estimated to go out within about 90 days after final approval and the resolution of any appeals. If you do nothing, you will not receive a payment, you will remain in the settlement classes, and you will give up your right to sue Concord over the claims the settlement resolves. If you opt out, you keep your right to sue but cannot receive a payment.
