Minnesota Orthodontics and Dentofacial Orthopedics, P.A. — referred to on the settlement website as MN Orthodontics — reached a class action settlement to resolve claims arising from a data security incident that occurred in or around February 2025. According to the settlement notice, an unauthorized third party gained access to the practice's computer systems and network and may have accessed the private information of current and former employees and patients.

What Happened?

According to the settlement notice, in or around February 2025 an unauthorized third party breached the MN Orthodontics computer systems and network and may have gained access to files containing the private information of current and former employees and patients. The settlement administrator identified the affected individuals and mailed them notice of the incident.

Reporting on the incident placed the number of people affected at roughly 501. The private information involved in this type of incident can vary by person, but the settlement class was defined to include everyone in the United States whose personal information was potentially compromised in the data incident and who received notice of it.

Who Was Included?

The settlement class consisted of all individuals residing in the United States whose personal information was potentially compromised in the MN Orthodontics data incident that occurred in or around February 2025, including all those who received notice of the incident. If you were sent a notice with a Claim Number and PIN, you had been identified as a class member.

As in most settlements, certain people were excluded, including the defendant and its officers and directors, the judge assigned to the case and immediate family, and anyone who timely opted out of the settlement.

What the Settlement Offered

Settlement class members who filed a valid claim could choose one of two main benefits — they could not claim both:

Credit Monitoring. Two years of free IDX identity protection and credit monitoring. According to the claim form, IDX Identity Protection Services provides single-bureau credit monitoring, dark web monitoring, $1,000,000 in reimbursement insurance, and fully managed identity recovery and lost wallet assistance.

Alternative Cash Payment. A cash payment of $25. Class members who claimed the credit monitoring above were not entitled to this alternative cash payment.

Per the claim form and the settlement's Long Notice, class members could also submit a claim for compensation for documented unreimbursed losses connected to the incident. The Long Notice described an aggregate cap on claims; the official settlement website and notice were the sources for those details. Class members who filed by mail received the alternative cash payment as a physical check, while those who filed online could elect an electronic payment.

What Proof Was Needed?

Filing required the Claim Number and PIN printed on the mailed notice to establish class membership, so filing was gated on an administrator-issued identifier — this settlement was treated as proof-required. The $25 alternative cash payment and the credit monitoring did not require receipts, but a claim for documented unreimbursed losses required supporting documentation.
