A settlement has been reached in a class action lawsuit against Derick Dermatology, PLLC. The case, Jeffries v. Derick Dermatology, PLLC (Case No. CACE-26-003864), is pending in the Circuit Court of the 17th Judicial Circuit, in and for Broward County, Florida.
The complaint alleges that Derick Dermatology disclosed website visitors' information to third parties through pixels, cookies, code, and other tracking or analytics tools on its website, allegedly without permission. The plaintiff asserts claims for violation of the Federal Wiretap Act (18 U.S.C. § 2510, et seq.), breach of fiduciary duty/confidentiality, invasion of privacy, breach of implied contract, unjust enrichment, and negligence.
Derick Dermatology denies that it violated any law and denies any wrongdoing. It agreed to settle solely to avoid the cost, distraction to its business operations, and uncertainty of continued litigation. The settlement is a compromise and is not an admission of liability by the defendant. The Court has not decided who is right.
The Settlement Class is defined as all persons who, from November 21, 2023 through November 27, 2025, made an appointment on www.derickdermatology.com or a subdomain of that website.
Excluded from the class are: any judge or magistrate presiding over the case and their families; the defendant, its parent companies, subsidiaries, successors, predecessors, and entities it controls, along with their current and former officers, directors, agents, attorneys, and employees; anyone who timely and properly excludes themselves; and the legal representatives, successors, or assigns of any excluded person.

There are two separate benefits in this settlement:
1. Cash payment — up to $12.50. Class Members who file a valid Claim Form can receive a cash payment of up to $12.50. The cash amount may be reduced pro rata (a legal term meaning equal share) if the total value of all approved claims exceeds the funds available for distribution. Filing a Claim Form is the only way to receive the cash payment.
2. One-year Privacy Shield Pro subscription — automatic. In addition to the cash payment, every Settlement Class Member automatically receives a code to redeem a one-year subscription to the Privacy Shield Pro identity-theft-protection product at no cost. Enrollment codes were sent to Class Members by email or U.S. mail. You do not need to file a claim to receive the Privacy Shield Pro code, but you must enroll after the settlement is approved and the Effective Date has passed. Enrollment codes become active within 5 days after the Effective Date, and enrollment must be completed within 95 days of the Effective Date.
Under the Settlement Agreement, the defendant and/or its insurers will pay up to $1 million to cover: notice and settlement administration expenses; the Court-approved award of attorneys' fees, costs, and expenses for Class Counsel (no more than $350,000); a service award to the Class Representative (up to $1,500); the up-to-$12.50 cash payments; and the cost of the one-year Privacy Shield Pro subscriptions.
To receive the cash payment, you must complete and submit a Claim Form online or by mail, postmarked or submitted online by July 21, 2026. Claim Forms can be submitted online — or downloaded and mailed — at the official settlement website. Class Members are encouraged to file online.
Remember: the Privacy Shield Pro subscription is separate and automatic. You only need to file a Claim Form for the cash payment; the Privacy Shield Pro code reaches you regardless, as long as you enroll within the deadline after the Effective Date.
- June 22, 2026 — Deadline to exclude yourself (opt out) or object to the settlement.
- July 21, 2026 — Deadline to submit a Claim Form for the cash payment.
- August 17, 2026 at 10:30 AM EST — Final Approval Hearing (held via Zoom).
If you exclude yourself, you keep your right to sue the defendant separately but give up the cash payment and the Privacy Shield Pro subscription. If you do nothing, you remain in the class, give up your right to sue over the released claims, and will not receive a cash payment. To object, you must follow the written-objection procedure described on the settlement website and in the Settlement Agreement.
The hearing date may change without further notice, so it is a good idea to check the official settlement website to confirm the date and time.
The legitimate way to file is through the official settlement website only. No legitimate settlement administrator will ask you to pay a fee to file a claim or demand your full Social Security number to "release" a settlement payment. Be skeptical of unsolicited texts, calls, or emails pressuring you to act immediately or share sensitive financial details.
Who qualifies for the Derick Dermatology pixel settlement?
You are a Settlement Class Member if, from November 21, 2023 through November 27, 2025, you made an appointment on www.derickdermatology.com or a subdomain of that website. Judges overseeing the case, the defendant and its affiliates, and anyone who timely excludes themselves are not included.
How much money can I get?
Class Members who file a valid Claim Form can receive a cash payment of up to $12.50. That cash amount may be reduced pro rata (an equal share) if the total value of approved claims exceeds the funds available. The defendant and/or its insurers will pay up to $1 million total to cover cash payments, the Privacy Shield Pro subscriptions, notice and administration costs, attorneys' fees, and a service award.
Do I need to file a claim to get the Privacy Shield Pro subscription?
No. Every Settlement Class Member automatically receives a code to redeem a one-year Privacy Shield Pro subscription at no cost. Enrollment codes were sent by email or U.S. mail and become active within 5 days after the Effective Date. You must enroll within 95 days of the Effective Date. Filing a Claim Form is only required for the up-to-$12.50 cash payment.
What is the deadline to file a claim?
Claim Forms must be submitted online or postmarked by July 21, 2026. The deadline to exclude yourself or object is June 22, 2026, and the Final Approval Hearing is scheduled for August 17, 2026.
Do I need proof to file a claim?
The notice does not require receipts or out-of-pocket documentation to claim the cash payment. You file by submitting a Claim Form online or by mail at the official settlement website and attesting that you made an appointment on derickdermatology.com during the class period.
