What is The $2.5M Duty Free FACTA Class Action Settlement?

A $2,500,000 class action settlement has been reached over certain Duty Free locations in the United States unlawfully printing out sensitive customer information such as the first six and last four digits of customers' credit cards. The class action lawsuit was settled with DFS Group, which owns duty free retail stores across the United States. According to the class action lawsuit, DFS Group violated FACTA law by printing too much customer credit card information on receipts at some of their locations, potentially compromising the security of consumer information and identity.

The Fair and Accurate Credit Transactions Act (FACTA), passed in 2003, requires all firms to preserve and dispose of sensitive and personal data they collect about their clients regardless of size or industry. Its goal is to help clients prevent identity theft by allowing them to set fraud warnings on their credit reports. Customers' rights to access copies of their credit reports and scores, as well as information about how those scores are calculated, are also protected.

DFS Group has denied violating the FACTA law, but has agreed to pay the settlement fund out to valid claimants in order to release the claims of the class action lawsuit, resulting in the $2.5 million class action fund.

How Do I Qualify for a Payout?

To qualify for a payment from the $2,500,000 duty free settlement fund you must file a valid and timely claim form by the deadline of July 16, 2024. In order to qualify for a payment you must meet the following requirements:

• You must be a person in the United States,

• The qualifying purchase must have been made at any point from May 27, 2020 to June 30, 2022

• You must have completed a transaction and received a receipt from one of the qualifying Duty Free locations,

• Your printed receipt must have displayed the last four and first six digits of your credit or debit card account number used in the transaction at the duty free.
