What Was the Case About?
Plaintiffs alleged that Everlywell and its Natalist brand installed third-party tracking tools — including advertising pixels built by Meta and Google — on their websites, and that those tools transmitted information about customers, including personally identifiable information tied to the tests they bought, to Facebook and Google without proper authorization. Who Was Covered?
The class covered people who purchased a product or service from Everlywell.com or Natalist.com between April 4, 2019 and December 3, 2024. Members were sorted into two subclasses based on what they bought.• Sensitive Test Subclass — approximately 660,000 people who purchased tests treated as sensitive, such as tests for sexually transmitted infections. Allocation: $2.64 million.
• Non-Sensitive Test Subclass — approximately 1.34 million people who purchased other tests. Allocation: $2.36 million.
How Much Could Class Members Get?
Payments are pro rata within each subclass, so the per-person amount depends on how many valid claims were approved in that subclass after court-approved fees, costs and administration expenses were deducted. Members of the sensitive-test subclass draw from a larger allocation shared among a smaller group, so their share was expected to be higher.
