What Was the Case About?

The lawsuit alleged that Everything Breaks, Inc. placed telephone solicitation calls to people who had registered their numbers on the National Do Not Call Registry, or who had previously told the company not to call or that they were already covered, in violation of the Telephone Consumer Protection Act. Everything Breaks denied the allegations and did not admit wrongdoing, but agreed to establish a settlement fund to resolve the case.

The TCPA restricts how businesses use telemarketing calls, texts and pre-recorded messages, generally requires prior express consent for solicitations, and gives consumers a private right of action for violations.

Who Was Covered?

A person was potentially eligible if either of the following applied: they received two or more telephone solicitation calls from Everything Breaks between March 1, 2023 and March 15, 2024 on a number that had been listed on the National Do Not Call Registry for at least 31 days; or they received two or more telemarketing calls within a 12-month period, with at least one call placed after their number was marked "DNC," "Do Not Call" or "Already Covered" in Everything Breaks' records.

How Much Could Claimants Get?

Everything Breaks established a settlement fund of $995,000. That fund covers payments to claiming class members, attorneys' fees of no more than 25% of the fund subject to court approval, litigation costs and expenses, the costs of notice and administration, and a service award to the class representative of no more than $5,000, also subject to court approval. The notice estimated payments between $36 and $144 for approved claims, with the actual amount depending on how many class members participated.

What Was Required to File?

Class members had to submit a valid claim form by April 9, 2025, online through the official settlement website or by mail to the settlement administrator. The published notice did not describe a receipts or documentation requirement, so this page is marked as requiring no documentation.

What Happens Next?
