What Changed Recently?

Claims opened after the Pemiscot County Circuit Court granted preliminary approval on September 24, 2026, and the administrator began emailing notices to class members. The case, Jane Doe and Janet Doe v. Missouri Delta Medical Center, was first filed in December 2022 in Scott County and moved to Pemiscot County in February 2023. The court denied MDMC's motion to dismiss in February 2024, and the parties settled after an April 2026 mediation.

The plaintiffs allege that tracking tools on MDMC's website, including Meta Pixel and Google Analytics, sent patients' information to third parties without authorization. MDMC, which the settlement agreement describes as a small rural health system about 200 miles south of St. Louis, firmly denies the claims and says it did nothing wrong. It agreed to settle to avoid the cost and uncertainty of continued litigation.

Who Qualifies?

The settlement class is all living Missouri patients of MDMC who logged into the MDMC Patient Portal between October 1, 2017 and December 31, 2022 and who are on the settlement class list MDMC provided to the administrator. The settlement agreement estimates the class at about 8,291 people.

Excluded are the judges presiding over the case, court staff and their immediate families; MDMC, its affiliates and their current or former employees, officers and directors; and the lawyers for both sides.

How Much Can You Get?

Each class member who files a valid claim receives a fixed $20.00 cash payment, limited to one per person on the class list. MDMC pays approved claims separately from attorneys' fees, service awards and administration costs, so the agreement does not describe a fund that shrinks as more people file. Payment is by check unless the claimant chooses PayPal, Venmo or Zelle, and checks expire 60 days after they are issued.

Separately, every class member is emailed a link and activation code for one year of CyEx Privacy Shield, with no claim needed. The agreement describes it as including a VPN, a password manager, data broker opt-outs, private search and a digital vault, and values a one-year subscription at more than $330. Class members have 90 days from when the codes are sent to enroll.

MDMC also agrees to keep Meta Pixel, Google Analytics and similar tracking tools out of its patient portal for three years after final approval. Class counsel may ask the court for up to $575,000 in fees and costs, and the two named plaintiffs may ask for up to $2,000 each; MDMC pays these separately.

What Proof or Notice ID Is Required?

No receipts or medical records are needed, but the claim is gated on the notice. The online claim form opens only after the claimant enters the Class Member ID from the notice and their last name. The notice and paper claim form also ask for the Settlement Class Member Login ID and password printed on the notice, and claimants attest under penalty of perjury that they are eligible. The official site says class members who did not receive their login details can contact the administrator to verify their identity and get them.

What Is the Deadline?

• Claims: submitted online by 11:59 p.m. EST on December 28, 2026, or mailed and postmarked by December 28, 2026.
• Opt-out: a signed written request mailed or delivered to the administrator by November 25, 2026.
• Objection: filed with the court and mailed to class counsel and defense counsel, postmarked by December 28, 2026.

How Do You Take Action?

Claims are filed on the official Claim Form Login page, which asks for the Class Member ID and last name before opening the form. A printable claim form is on the site's Settlement Documents page for anyone filing by mail. The CyEx Privacy Shield activation code arrives by separate email.

Opting out ends any right to the $20 payment and Privacy Shield, and is the only way to keep the right to sue MDMC separately over these claims. Class members who do nothing receive no cash but are still bound by the settlement's release.

What Happens Next?

Judge Joshua D. Underwood will hold the final approval hearing on January 4, 2027 at 9:00 a.m. at the Pemiscot County Courthouse in Caruthersville, Missouri. The notice says the hearing may be held remotely, with instructions posted on the official site, and that it may be moved without further notice. If the court approves the settlement, approved claims are paid 60 days after final approval and the end of any appeals. No payment date has been announced.

Questions

Does a Missouri Delta Medical Center patient who never used the patient portal qualify?

No. The settlement class covers living Missouri patients who logged into the MDMC Patient Portal between October 1, 2017 and December 31, 2022 and who appear on the class list MDMC gave the administrator. Visiting MDMC's public website or being treated there without using the portal is not enough under the class definition.

Is the $20 reduced if many people file claims?

The settlement agreement sets a fixed $20.00 cash payment per approved claim, limited to one per class member, and MDMC pays approved claims, attorneys' fees, service awards and administration costs separately. The agreement does not describe a shared fund that is divided pro rata.

Do class members have to file a claim to get CyEx Privacy Shield?

No. Under the settlement agreement, the administrator emails every class member a link, activation code and instructions for one year of CyEx Privacy Shield. Class members have 90 days from when the codes are sent to enroll. The $20 cash payment is the only benefit that requires a claim form.

What does Missouri Delta Medical Center have to change under the settlement?

The settlement agreement says MDMC will continue not to use Meta Pixel, Google Analytics or similar third-party tracking technologies within its patient portal for three years after final approval. It may still use HIPAA-compliant vendors under a business associate agreement for analytics that do not send patient information for advertising or marketing.
