What Is This Settlement About?

Novant Health, Inc. — the North Carolina–based hospital and healthcare system — agreed to a $750,000 settlement to resolve a collective action filed under the federal Fair Labor Standards Act (FLSA). The case, captioned Corley v. Novant Health, Inc., No. 1:24-cv-00772-WO-JEP, is pending in the U.S. District Court for the Middle District of North Carolina. The lawsuit alleges that Novant Health's timeclock rounding policy, in place through February 11, 2023, caused some hourly employees to lose overtime pay they had earned.

Novant Health denies the allegations and contends that it paid its employees properly for all hours worked; the company agreed to the settlement to avoid the cost and disruption of continued litigation, and the court has not ruled on the merits of the claims or made any finding of wrongdoing. The court granted preliminary approval and certified a collective for settlement purposes. Eligible employees can now file a claim for a cash payment. Who Qualifies?

The settlement covers hourly employees who worked for Novant Health between September 19, 2021 and February 11, 2023, and who: (i) were subject to the timeclock rounding policy; and (ii) worked at least one workweek of 40 or more hours during that period. Eligible class members were mailed a postcard notice containing an ILYM ID used to file a claim.

Because this is an FLSA collective action, eligible employees must affirmatively opt in by submitting a valid claim form. Those who do nothing will not receive a payment and will not release any wage-and-hour claims. Anyone who previously opted in to the lawsuit does not need to submit a claim form and will be paid following final approval.

How Much Can You Get?

Individual payments vary. The total maximum settlement is $750,000, which also covers court-approved attorneys' fees and costs (up to $265,000), a service award to the named plaintiff (up to $5,000), and claims-administration costs ($76,270). Each participating employee's payment is a proportional share of the amount allocated to the collective, calculated from the number of workweeks the person worked in a non-exempt hourly position during the eligibility period — so employees with more qualifying weeks generally receive larger payments. The estimated amount is reflected in each eligible person's mailed claim form.

How to File a Claim

To receive a payment, you must submit a valid claim form online or by mail, postmarked or electronically submitted no later than July 10, 2026. The online claim form on the official settlement website requires the ILYM ID and last name printed on the postcard notice mailed to eligible employees.
