CVS Pharmacy, Inc. and Criteo Corp. have reached a proposed settlement with a maximum cash payment of $20.5 million, and the official website is accepting claims. The lawsuit alleges that technology embedded in CVS digital properties disclosed users’ health or private information, browsing data, identifiers, or other personal data to Criteo and other third parties. Both defendants deny violating the law, and the court has not decided who is right.The Wellstar website tracking settlement concerns a separate healthcare privacy case with its own eligibility rules and claim requirements.
Who Qualifies?
The settlement class covers all living individuals who accessed CVS digital properties in the United States before July 27, 2026. Covered properties include the CVS website, the CVS Health website, and the CVS app. The claim form also requires a declaration that the claimant was a U.S. resident at the time of access.Eligibility is based on accessing a covered digital property; the stated class definition does not require a purchase. An in-store purchase alone does not establish the required website or app access. The notice gives a cutoff date but does not state a beginning date for the class period.
How Much Can You Get?
There are two alternative cash options:- Cash Payment B: up to $5 without documentation. No proof or explanation is needed to request this option.
- Cash Payment A: up to $10 with valid documentation showing membership in the settlement class.
You choose one option, not both. Neither amount is guaranteed: payments may be reduced proportionately depending on the number of valid claims. The $20.5 million maximum first covers court-approved attorneys’ fees and costs, service awards, and settlement administration; the remaining money funds class payments.
Only one claim may be filed per household. The settlement defines a household as everyone living at the same mailing address, and additional claims from that household will be denied. Visiting multiple CVS websites or using both a website and the app does not create extra household claims.
Class counsel may request fees, costs, and expenses of up to 37.5% of the maximum cash payment. The court may award less.
What Proof or Notice ID Is Required?
No proof is required for the up-to-$5 option. The official claim entry page offers a link to file without logging in, and that open form does not ask for a LoginID or PIN. A person who never received a notice can use that route.For up to $10, attach documentation showing access before July 27, 2026. The claim instructions give browser history, dated screenshots, and email receipts for online purchases as examples.
No proof does not remove the eligibility requirements. Claimants must certify under penalty of perjury that they accessed a covered CVS digital property while in the United States before the cutoff, were U.S. residents at the time, and supplied truthful information. Claims may be audited, verified, or reviewed by the court. The form also asks claimants to affirm agreement with the CVS Health Privacy Center disclosures.
What Is the Deadline?
Submit an online claim by November 16, 2026 at 11:59 p.m. EST. A mailed claim must be postmarked by November 16, 2026. How Do You Take Action?
Open the official CVS claim form without a LoginID or PIN. Enter your contact information, select Cash Payment B for up to $5 without proof or Cash Payment A for up to $10 with documentation, choose a payment method, and complete the certification and signature.The online form offers PayPal, Venmo, Zelle, or a check. A valid mailing address is required even when choosing electronic payment. What Happens Next?
The final approval hearing is scheduled for December 1, 2026 at 9:30 a.m. EST by Zoom. The court will consider approval of the settlement and the requested fees and service awards. The hearing may be rescheduled, so check the official website for changes.The notice describes payment to valid claimants 120 days after final approval and/or completion of any appeals. That is conditional timing, not a guaranteed calendar payment date. Checks expire 180 days after issuance.
Remaining in the class releases the claims covered by the settlement if it becomes final, even if a class member does not request payment. Excluding yourself means giving up settlement benefits while retaining any right to pursue those claims separately. The official notice and agreement explain the scope of the release.

Can I file if I never received a settlement notice?
Yes. The official claim entry page links to an open form for people without a LoginID or PIN, including people who never received an email notice. Eligible class members can choose the up-to-$5 option without documentation.
Does every person at my address get a separate payment?
No. The settlement permits only one claim per household, defined as all people residing at the same mailing address. Later claims from the same household will be denied.
Do I need to explain why I have no proof?
No. The claim instructions say no proof or explanation is needed for Cash Payment B of up to $5. You must still meet the class requirements and sign the eligibility certification under penalty of perjury.
What happens if my electronic payment cannot be delivered?

Is a CVS store purchase enough to qualify?
