What Is the Penn Medicine Pixel Settlement About?

Cons. Stat. § 5701, et seq. (the "WESCA"), by disclosing patients' personally identifiable information to third parties through tracking pixels from Meta Platforms, Inc. (formerly Facebook) and Google LLC, along with other tracking, analytics, and advertising technologies. Penn Medicine denies all of the claims and maintains that it engaged in no wrongdoing. The settlement is not an admission of liability, and the Court has not decided that Penn Medicine did anything wrong.
Both sides agreed to settle to avoid the cost, risk, and uncertainty of continued litigation. As part of the agreement, Penn Medicine states it is not currently using the Meta pixel on the pennmedicine.org website and has agreed that, for the next two years, it will not use analytics and advertising technologies on that website unless its web governance committee determines the use is consistent with applicable law.

Who Qualifies for the Penn Medicine Settlement?
The Settlement Class is defined as all persons who, between January 23, 2021 and January 23, 2023, accessed the myPennMedicine patient portal and had a Pennsylvania address on file at the time of access. This class definition was chosen because records readily exist to determine who is a member.You likely received a postcard or email notice because Penn Medicine's records indicate you fit that description. How Much Can You Get From the Penn Medicine Settlement?
Each Settlement Class Member who files a valid claim will receive a cash payment of up to $15.00. Penn Medicine has agreed to pay up to a total of $9,500,000, which also covers the costs of notice and administration, court-approved attorneys' fees and costs to Class Counsel, and incentive awards to the class representatives.The payment is sent in the form of a check unless you elect a different method on your Claim Form. Available options include a digital payment through PayPal, Venmo, or Zelle; a digital Mastercard delivered by email; or an ACH transfer directly to a checking or savings account. If you select more than one payment option, you will be mailed a check.
If the Court approves the settlement, eligible class members with approved claims will receive payment about 90 days after the settlement becomes final and any appeals are resolved. All checks expire and become void 180 days after they are issued.
Do I Need Proof to File?
Yes. To submit a claim you must provide the Unique ID and PIN found on the front of the postcard notice you received by mail or at the top of the email notice you received. These administrator-issued identifiers verify that you are a Settlement Class Member, so a claim cannot be filed without them. Either way, your claim must be submitted online by 11:59 p.m. ET on September 16, 2026, or postmarked and mailed by September 16, 2026. After you file online, you will receive an email with a confirmation code — keep it for your records.
