What Changed Recently?

Prime Healthcare Services, Inc. and three of its California hospitals agreed to settle Doe, et al. v. Prime Healthcare Services, Inc., et al., Case No. 23STCV26800, in the Superior Court of California for Los Angeles County. The court granted preliminary approval after a September 22, 2026 hearing, notice has gone out, and the official settlement website is accepting claims. The settlement also resolves a related federal case, R.S. v. Prime Healthcare, No. 5:24-cv-00330 (C.D. Cal.), whose claims were folded into the state case.

The plaintiffs allege that tracking tools on Prime's hospital websites, including the Meta Pixel and Google Analytics, sent patients' health information to third parties such as Meta and Google in violation of California privacy and medical-confidentiality laws and the federal Electronic Communications Privacy Act. Prime Healthcare denies any wrongdoing and denies that any tracking tools ever operated inside its password-protected patient portals. The court has not decided who is right.

Who Qualifies?

The settlement class covers patients of Prime Healthcare and its listed hospitals who accessed or used any of 29 Prime web properties from November 1, 2019 until the date tracking pixels were removed from that site. The end dates run from October 12, 2022 to October 18, 2023 and are listed site by site on the settlement website. The covered hospitals are in California, Texas, Pennsylvania, New Jersey and several other states; the full list is on the settlement website.

Benefits depend on which of two subclasses a person falls into: Someone in both subclasses is treated as a Patient Portal Subclass member. Class members in neither subclass are still part of the settlement and bound by it, but receive no cash or monitoring code.

How Much Can You Get?

Patient Portal Subclass members can claim a one-time $20 cash payment. It is a fixed amount, not a share of a fund, so it does not shrink as more people file.

Patient Portal and Email Subclass members also receive an activation code for one year of CyEx Medical Shield Pro, sent with their notice; no claim form is needed for it. The service includes dark web monitoring, medical record number monitoring, real-time authentication alerts, security freeze assistance, victim assistance and $1 million of identity theft insurance. Enrollment closes April 20, 2027, and the code stops working after that date. Enrolling asks for the activation code plus name, address, date of birth, phone number, email address and Social Security number.

Prime has also agreed not to use Google Analytics or the Meta Pixel on the covered websites for five years after final approval, except under business associate agreements, and to have an internal committee audit its websites every year. Prime pays the cash, the monitoring, administration costs of about $140,000, attorneys' fees and expenses of up to $2,000,000, and service awards separately; class members are paid in full before any fee is paid.

What Proof or Notice ID Is Required?

The online claim portal starts with a login that asks for the Class Member ID from the notice, and the paper claim form asks for the Notice ID if known. No receipts or records are required. The claimant attests that they accessed or used a Prime patient portal during the relevant class period, and the administrator checks each claim against Prime's class list.

What Is the Deadline?

Claims must be submitted online by December 21, 2026, or mailed with a postmark no later than December 21, 2026. Requests for exclusion must be emailed or postmarked by December 21, 2026, and objections emailed or postmarked by January 20, 2027; objections can also be made in person at the final approval hearing. The site gives no time of day for the deadlines. Class members whose notice was re-sent after being returned undeliverable get an extra 14 days.

How Do You Take Action?

Claims go through the Submit Claim button on the official settlement website, PHSettlement.com, run by the settlement administrator, Kroll Settlement Administration. A paper claim form can also be downloaded from the site's documents page and mailed. The $20 can be paid by check, Venmo, PayPal or Zelle, and a check is sent if no method is chosen. The Medical Shield Pro code is activated separately, following the enrollment instructions that came with the notice.

What Happens Next?

The claim and exclusion deadline is December 21, 2026, and the objection deadline is January 20, 2027. Judge Samantha P. Jessner will hold the final approval hearing on March 9, 2027 at 10:00 a.m. Pacific Time in Department 7 of the Spring Street Courthouse in Los Angeles, where the court will also decide the fee request. If the settlement is approved, the $20 payments are due within 60 days after the effective date, and checks expire if they are not cashed within 180 days.

Questions

Who can claim the $20 Prime Healthcare payment?

Only Patient Portal Subclass members: Prime Healthcare patients who accessed or used one of the patient portals tied to the 29 Prime web properties during that property's class period, which starts November 1, 2019 and ends between October 12, 2022 and October 18, 2023 depending on the hospital. The online claim form asks for the Class Member ID from the notice.

Does everyone get the free CyEx Medical Shield Pro monitoring?

No. The activation code goes automatically, with the notice, to Patient Portal Subclass members and to Email Subclass members, who were patients at one of Prime's California hospitals from November 1, 2021 through the hospital's class period end date and gave Prime an email address. Enrollment closes April 20, 2027. Class members in neither subclass receive no cash or monitoring; their benefit is the five-year commitment on tracking tools.

Do attorneys' fees come out of the $20 payments?

No. Under the settlement agreement, Prime Healthcare pays the $20 cash payments, the monitoring codes, administration costs of about $140,000, attorneys' fees and expenses of up to $2,000,000, and service awards separately. Class members are paid in full before any fee award is paid.

How will the $20 be paid?

By check, Venmo, PayPal or Zelle; a check is sent if no method is chosen. Payments are due within 60 days after the settlement's effective date, which follows final approval and the end of any appeals. Checks expire if not cashed within 180 days.
